Like I said previously 3 months is more than enough if there was a problem then I would have refunded it's not my fault he didn't fit it straight to his car if I was hiding something I wouldn't have given any warranty at all would I there was nothing wrong with that diff, if i warranted parts from when they are fitted how would I know if customers lied about when they fitted it not saying magpie has done this but I can't have rules for someone and different for others, that was in response to hoobs question btw

So he could have fitted it, ragged the life out of it for 2 months and 3 weeks, then asked for a refund which you'd pay because it's before your 3 month limit?

Instead, it sits unused for 4 months (which he says he's proved) but you won't consider a refund because the limit has passed?

That said, you refuse to accept there's a problem with the diff anyway, because you said you checked it. Why would that be any different if this was a month ago?

If you have a problem me with the diff it is your right to be refunded within 3 months that how it works and yes we do get done over by a lot of people who would do what you said above its a nightmare that's why I can be lenient on warranties it's three months end of sorry

in fairness to all involved I can see where the 3 month warranty kicks in, but at the same time if Mick hasn't used it at all (and I believe him ) the item hasn't withstood 3 months of use, that's poor

I'm fairly sure mick wouldn't make it up, he would rather be driving his car than underneath it with diff drama's

surely there's middle ground here somewhere?

No one can see where I'm coming from ether was nothing wrong with that diff if he knew he wasn't going to fit it for four months why buy it or ask what warranty it came with I would happily have held it for him, but like I've said I had no problems with it and it's been over 3 months

I would completely agree with alpina123 if this was a sale outside of the zone but its not. Mick is a trusted member and contributor to the zone, I would have no reason to question his honesty.

The zone is a site for enthusiasts and shouldn't be used as a cheap portal to flog scrap.

What's the difference between magpie and someone walking down the street? There isn't one to me like I said customers don't get treated differently just because they have bought something through the zone your telling me if you had bought the diff outside of here you would of said oh we'll next time I'll order through the zone because it means I know something?

You're arguing from a point of technicality (warranty).

The difference between the zone and elsewhere is this is a small community of enthusiasts. I would expect sellers to be less mercenary than the high street. So yes, I would rather buy from the zone because you expect to be treated fairly.

I treat no customer different form the next regardless of where its being sold or who to it Is the only way it can be done otherwise it would be unfair to anyone else a 3 month warranty is more than enough as I said previously it wouldn't be worth my time to be selling shit then putting a 3 month warranty on it would it?

This is where your opinion and mine differ. I would see him as being different because he's a fellow zoner / enthusiast, on a forum where we supposedly support one another.

In return for selling here (for free), is it too much to expect that we give each other the benefit of the doubt? Magpie is a long standing member of the zone and as such, it seems his word is worth taking.

So what if the diff sat unused? It's a piece of precision engineering, not a loaf of bread. LSD's don't go stale do they? I think it's a shame that you guys couldn't work out an amicable solution. Instead, you've most likely damaged your reputation as a seller instead.

Look I'm sorry but I sold a good diff that had no problems whatsoever ever with it it had done 50k miles, it comes with a standard 3 month warranty if it was within this time he would have got his money back regardless the fact it isn't means I won't refund because it just means I'll have a no good diff but no one cares about that as long as magpie gets his money back because everyone likes him, I don't come on public forums to gain respect, I come on them because I am into cars and enjoy time on here

Someone is being less than honest then. Either you supplied a perfect diff, as you state. Or Magpie has damaged it since taking possession?

I don't know Magpie but any seller has to accept responsibility for the stuff they sell. Why is your word to be taken over his? What possible explanation is there for the diff failing despite it not being fitted?

This seems to be a catch 22 situation really.in alpina 123 defence he sold it with warranty and the warranty has passed.in magpies defence the item is clearly faulty and he hasn't had 3 months use from the item.its only just been fitted.this is not gumtree or eBay.its supposed to be a place where everybody loves cars and generally help each other out. Surely some agreement can be reached.if it was me considering the facts.id pay back half the money.split the loss 50 /50. Just my 2 pence worth

Look at the end of the day it don't know what could have happened to that diff now, so after the three months why should I then give him half his money back when I knew it was a good diff?

Realistically, some form of comprise is going to have to be met. As I see it:

Do nothing: Magpie is left with a f**ked diff + £260 out of pocket and this is left as a stain on your reputation.

50/50 split: Damage limitation

Full refund: All is well in the world, other than this thread which can be removed at the request of Magpie.

Magpie paid £260. If you are in the breaking cars game, it didn't cost you £260 so your loss isn't as sore and you can continue flogging car bitz.

Also how would you know what that car owed as a breaker, your don't know what I paid for it and what I sold just because I may have made a profit on the whole car by selling the engine does not mean I have to give everything else away now does it? I wonder if that's what magpie does when he breaks cars?

You break cars, you could easily make up the difference by selling parts on here.
