If its not mentioned in the auction then thats a contract breaker because the seller was not being truthful (although he may not even know it). this only applies if a statement is made as to the quality of the vehicle being allegedly in tip-tip order - which would make it a false statement. but in reality there is no obligation on the seller in this area, the obligation arises if the seller is directly questioned on "has the car ever had a prang mate?" and he says no (knowing full well it has) then there is a deliberate misrepresentation made.
