Surely the sensible thing to do when things don't go right in a sensible time frame, is to draw a line under it and say, "I'm sorry, this ain't working, heres your money back"?

And 18 months is not a sensible time frame in anyones book.

I wouldn't disagree with that and I'm happy to refund him as I stated to him in the mail quoted above, but after three messages, without response, I don't think it's really up to me to chase him.

I probably should have sent a further reminder and occasionally when I move the box or trip over it, it comes to my mind, but more pressing stuff takes over.

I haven't moved address or email address in that time.

I've contacted him on M5 board and sent another email to the address I have.

So this guy just forgot about his $500 for the best part of 18 months? Similar has happened to me before but they have always come through in the end without problems.
Can I ask why the courier was arranged from US end? It just sounds like a recipe for disaster to me....
IMO if you wanted the parts sold and gone you would have arranged it all yourself, I know I certainly would have.

There have been developements...

My situation is now as-follows:

Boyd has admitted receiving my seven day letter, send to him by recorded delivery.

He suggested that I needn't incure any solicitors fees as I would get my money, probably by the end of October..

I pointed out that the 'within a few days' offer posted here on the zone had expired & that I would require an interim payment of £200 by the (then) coming weekend, otherwise I would issue proceedings.

I got a payment of £10.00 as a 'test'. It arrived the same day, so no problems with Santander...!!

I confirmed the arrival of the 'test' sum and I then got a payment of £100.00.

This is not what I asked for, but I will be waiting until the end of October, by which time I will require the £500 still owed.

Otherwise, as I said to Boyd during our recent exchange, what earthly reason is there for me to hold off on legal action??


As for the actions of the mods on this board, at what point will they be unlocking the 'other' thread?
They seem to have been very quiet over this matter, though I note that another trader has the 'Warning, unreliable seller' tag... Whooopeee.

Just out of interest, what does it take to get someone banned from this board?? Seems you'll get banned if you warn others about dodgy dealings...??


EDIT: I've just had a very good message from Mike (mod) explaining the 'zones view on all this. It looks like the situation is being closely monitored & there is very good reason why dodgy traders DON'T get banned from the 'zone....

Just thought I'd add my tuppence worth since I've seen a couple of these threads going recently.

I've met and dealt with Boyd for various deals, including giving him £4k up front to check out and buy my Motorsport Convertible from Oxford and transport it North, back to civilisation. He's always been a pleasure to deal with and as far as I'm concerned completely trustworthy.

I will no doubt continue to use Boyd as a source of parts and am a bit surprised, and disappointed at the big red tag in his Avatar. There seem to be a lot of people looking to rubbish someone's name very quickly - is there perhaps a clique in here trying to corner the parts market by knobbling the competition?

Ultimately this is potentially someone's livelihood that is being impacted so it's important the Mods are diligent in their investigations prior to marking a long standing and known seller as "unreliable".

Right, I'll get back in my box again...... :)

He has owed this bloke money for 10 months. It has been looked at very closely by a lot of people. I would hardely call it "quick",

I have sympathy for both boyd and barx, seems both of them are decent blokes who have made a fack up or 2 amongst allot of good trades, either way- messing people around, even just once can cause allot of bad feeling.

As for protecting your livelihood, if its that important to someone, they would have sorted things well before it came to this. Your meant to protect your own livelihood- Its not the buyers responsibility to do it for you. You cant provide the goods or service within a reasonable time frame, you refund and appologise. job done.

Personally, i choose to look past one bad deal and probably wouldnt hesitate to use either barx or boyd, although i would be alittle carefull.

I've known Boyd for about 11 years.
He's bought cars off me too, an M5 engine & I've had an E39 off him.

I responded to a similar thread to this one on Forum5 BMW.
I stood up for him there like you are doing now!
Because: I thought I knew & could trust him.

Anyway, have you actually fully~read this thread & other, similar ones???

Knowing him for over a decade didn't stop me & a guy called Asif being Royally mucked-about and I'm still £500 out of pocket, despite promises of a full refund....

I don't think Boyd deliberately sets out to rip people off (or perhaps I should say, I hope he doesn't...), but sorry to say, regardless of his intentions, the end result is the same.

Agreed, Boyd is a charming, affable chap, which in a way just adds to the insult I feel.
After all, if he came over as a dodgy scumbag, the alarm bells would have been set-off LONG ago & I wouldn't have trusted him over a transaction that has gone so horribly wrong....

Trisman, what was the reason given by the MOD why traders like Boyd dont get banned ?
About 12 months ago, i started a similar thread about Boyd oweing a friend of mine some money. It took him over 12 months to get his money back, it has taken Trisman 10 months to get £110 of £610. If Boyd cant deliver the parts or service, why should he be allowed to sit on peoples money. I really dont like to say it but these are clear signs of a desperate guy robbing Peter to pay Paul.
If Boyd has known Trisman and was not shy in taking £610 of his money, what hopes do the rest of us have.
Please note, i am not stirring the situation, i just dont like people i know being mucked about.

It looks like one of the traders did a fair amount of business here, his new 'Warning, Unreliable seller' avatar *might* make people think twice about who they buy stuff from...

Anyway, my 'issue' with Mr Beattie has been going on since Aug the 1st, that's the date I finally got sick of the excuses and asked for my money back.

There had been a good few weeks of messing about & broken promises prior to that.

Monday is the 31st of October, the day by which Boyd has said I'd get the rest of the money refunded.

If I don't get it by that date, I'll be getting the Sheriffs officers to serve a summons on Boyd, after which (following Judgement) the Bailiffs can sort it out.

I'm not going to be messed about any further in the event that Boyd breaks yet another promise to repay my money.

He didn't do a lot of business on BMW5.forum & the Mods there got fed up of the reports they were getting, so he got a permanent bad.

Looks like they have changed their policy. Look at the last post on this URL. Last time i tried to resolve a problem for a pal, the MOD locked the thread and told me to continue the discussion off forum.

No legal action was necessary I'm pleased to report, as I have been paid back most of the money owed.

I'm due a final payment of £100 and then the whole sorry saga can get a very firm line drawn under it.

Disaster.

I booked and paid for Saturday delivery but when I got it back yesterday, it sounded as if there was "stuff" rattling about inside. I opened the package and a load of the the aluminium fins had turned to dust. It appears to be where I packed it tightly to avoid damage, but now even light finger presssure brushes away the fins. It looked OK, but now and on closer examination, it's u/s.

No matter I have another manual ready to break. It drove in so I'll have the rad out of that. Except when I go to take it out, it's an auto rad with the trans oil cooler bypassed.

I'm sorry and embarassed in equal measure. It's been a disaster from start to finish for a simple radiator. I have auto, but no manuals, it would appear.

I can't apologise enough, I'll obviously refund you immediately.

I am a business, yes, but I am not at my business premises all the time. I asked my neighbour to hand your radiator and some other bits to UPS when they turned up. None of these parts have been delivered. He is a decent young lad even if he is dealing in sooped up Jap stuff - financed by his dad. Anyway, he has the paperwork from the driver and I haven't been able to see him since I got back last Friday. I got his dad's number from the landlord today, the young lad is ill apparently and not at his work. His dad went to the unit tonight and phoned me to say that there were boxes addressed in his unit. He doesn't know what has happened, but it's clear that for some reason, they weren't collected. I've arranged to meet him to pick them up.

I'm sorry, it's partly my fault, but the transport business can take me away from the cars and parts side for days at a time.

What do you want to do? I'll obviously refund or send on.

I'm getting quite restless with the situation now as I'm sure you can imagine.

If you've sent it and it's not your fault then fair enough - just tell me if it's been sent and which company and also the tracking number).

But I'm begining to wonder if it's been sent at all as everytime I've asked you who it's been sent with you've not answered the question.

So, can you tell me what is going on as it's now been 20 days since I first messaged you about the radiator, 14 days since I sent the payment, 13 days since you said you were originally sending it, and 7 WORKING days since you said you received the payment and said you were sending it on an upgraded next day guaranteed delivery.

Come on this should take 1-2 working days max.
I've been in the parts supply and distribution game for 10 years now and I have multiple parts arriving and departing from here daily - I can't remember the last time myself or a supplier had a delivery issue getting something to me.

Are you a business as you don't have a traders status on this forum? If you are a business I'm dissapointed with the service.

Only reason is I've had one sent to me before then arrived with damaged cores due to lack of packaging.
