i dunno whats happened but at the moment i've just had a new lease of love for my iS, i'm just going through a phase at the moment of loving thrashing the t!ts off it everywhere i go! i think it might be the cold weather has given it a bit of extra grunt and as a result is better to drive. it might also be because the DVLA sent me a letter yesterday saying my licence has been revoked as of 2 days ago and if i dont send my licence off to have 3 points put on it they're gonna come and get me! they can p!ss off if they think i'm sending my licence off, (ooh i'm such an anarchist lol) i'm on 9 points as it is and if i send it off it'll be a ban and one of those driver courses-MEGA!

anyone know about revoking? it says i can drive for 12 months on a revoked licence? surely its just banned or not banned?

best to send of your license as they request or they will come for you early hours one morning and if they come for you they wont do you any favours in return when dealing with you. you cant beat the system nowadays in this computer linked era so its a waste of time trying. i cant see how you can drive if they have revoked your license and if you continue to drive im pretty sure it will end up with a driving with disqualified and with no insurance charge next time you come across a traffic police car meaning longer bans ,bigger fines and higher future insurance premiums.
im sure crossing the 12 point barrier isnt a statutory 12 month ban but a length of time determined by a judge so if you have co operated fully he will take that into account when sentencing.
if you fight the system they will crush you like a bug but if you play the remorseful, appologetic game they might be a bit easier on you.

unfortunately jumping a red light is seen as a much worse offence than speeding as it shows a level of carelessness/recklessness on the part of the driver .its also taken more seriously by the insurance companies because you are seen as a higher risk.

How long ago did you get the first of those 9 points ?

There is no "Mega-driving" course, that is for people banned for drink/drugs or death.

A "Revoke" is not a ban. its worse........

After a ban your licence is returned to you in the state it was before the ban, ie: Full or Provisinonal.

When your licence is revoked, Your Full licence status is taken off you and you are then classed as a learner again, and as such, have to retake a normal driving test, both tests.......to regain your Full licence.

I speak from experince.

sounds much worse then.
they always win and always have you over a barrel.if you dont play ball to begin with they shaft you even more. sounds like a simple ban situation has esculated into a much more serious issue

I am getting confused here........

To get a ban under toting up (12 pionts), you have to get a total of 12 in 3 years.

Are the DVLA revoking your licence because you have not sent it to them ?

god knows, i'm on 9 points currently, with 3 pending, i've not sent them my licence because if i do it, they'll put the three on and i will have got 12 in less than 3 years so i will be banned, so i've just been ignoring the letters hoping to drag it out til may when three will come off, but two days ago i got a letter saying i need to send off my licence AND from 11/11/07 my licence has been revoked BUT i can still drive on a revoked licence for 12months. thats the bit i dont get.

cheers for all the advice, keep it coming as i've never been in this situation before.

seems that being revoked is better than being banned though? i simply take my test again and start from scratch?

Surely the point will be put on from the point at which the offence was commited, so by delaying it all you're doing is p*ssing them off, and making it worse for yourself? :?

stop putting off the inevitable mate, their records have you as banned or revoked whatever, no stalling or pissing them off on your part is gonna change the fact. take your punishment, or in a few years time you'll look back and wonder why the hell you made a bad situation much worse.

your situation sucks pal to be sure but if i was on 9 points i'd be driving like a SAINT!

The newer points will apply from the date of conviction, not the offence.....

Bad news dude..........

The ban applys NOW. Plod dose check on PNC, it will show that you are banned.

The revoked bit is just a standard letter.

any points held on your full license will surely be tranferred to your provisional if you are back to learner status? points are applied to a provisional in the same way as a full license so i wouldnt think they would be wiped of for you to start from scratch. can you be insured to drive on a revoked license though ? im sure explaining this to an insurance company will either make them laugh and hang up on you or hit you with a seriously high premium.
can you post up a copy of the letter with your personal details blanked so we can try to understand this 12 months driving allowance?

The 12 month thing applys ONLY if:

1, You are not prevented from holding or obtaining one......

2, Any conditions for holding a licence are meet......

You are prevented from holding one because of the 12 points in 3 years. This is a 6 month ban, starting from the date of conviction.

so the letter says i should send off this form with a form for a replacement licence (i've lost my photocard and counterpart so need to replace it), so if i do that tomorrow i reckon i should send some sort of remorseful letter. i have a few excuses see what you think;

1. i'm a student and the paperwork was being sent to my old address from last year (which is true, i didnt here about this till 6 months after the incident when my dopey ex-housemate gave me all my post)

2. i'm a busy motherfuck£r who really cant afford to be banned

3. i also sent a letter to this Mike Rees fella months ago when i got sent a final warning saying that i hadnt had any correspondance regarding the matter and had no idea what he was talking about (also true, i did send him a letter when i got a warning because by that time my housemate hadnt given me my post but had no response from mike rees.)

4. since the matter got more serious the letters have been sent to my parents address (i'm a student) so i could say that i never go home to see my parents but on going home for christmas i had a bundle of letters to deal with and this was one?

any ideas? what you reckon i should do?!?!

thanks for your help again. you lot are mega

You basically need to bend over and take what's coming to you. They will laugh at any excuses you may try.

If you really piss them off, they can also fine you £1000 for moving without changing the address on your licence. Take the ban, and move on. You'll just make it worse if you try and get off.

Ian.

Ian is right.
And it doesn't matter what it says on your license. It matters what the DVLA have on their computer because that is what the Plod check when you drive past. If your license doesn't match what Mr Plod is reading on his screen then you're in for some pointy questions at the very least and if you ARE trying to blag it with an out of date license then you're in for something much worse. I don't know how much worse, but I wouldn't want to find out.

If I were you I'd go to the nearest DVLA office (by taxi because I doubt you'll be driving home) with all the paperwork you have (including license) and say "Here I am, what needs to be done". Get the whole lot out of the way and don't give them any cocky excuses. It will be in your favour that you wanted to get everything legal again. I can't see any point in getting a solicitor to try and fight your points, its too late for the old ones and for the last set you were bang to rights.
2. i'm a busy motherfuck£r who really cant afford to be banned
Translated into Official Speak is:
2. Rules? pftt, they're for the little people. Out of my way, peon
It won't do you any favours.

There is some pain coming your way, but the sooner you deal with it the sooner it will be over. Also, fobbing off the DVLA is like ignoring a credit card statement. You might think you're being clever in getting away with it but all you are doing is incurring more interest.

The points will carry onto your provisional license, they dont some off becuase you were banned and got YOUR lisence back. They stay on there till they are spent and then you have to send ur lisence off and pay for them to be removed.

As for trying to play dumb and not sending it off, they will screw you to the wall, give you a longer ban and if taken to court a fine as well as court cost. Just send it off!!!!!!!

And blaming your Mrs for the last 3 points due to an unfinished arguement and unmarked police car, hmm was it her who put her foot on the gas pedal..........NO it was you. You have not told us what the first 9 points were given to you for, but i guess it was for speeding as well especially since you say you love thrashing the tits out of it.

There is a good saying i heard "if you cant do the time, dont do the crime"

Im also gathering your quiet a young driver, so i will be sitting in wait for you to post another topic............'Why is insurance so high for young drivers'

Now be a man and face up to your own actions!!!!!!!

Better screwed than facing a heavy fine or locked up.

licence revoked = no licence .........condition of holding insurance ...that you are the holder of a licence =no insurance as well ....no ins +no licence is at least 9 further points plus several hundred in fines car seized by police £105 +£12 a day storage (in london anyway) and you need insurance and a licence before you can get it back ....no insurance company will want to know you

however if you are banned (i did not see the letter) and caught then, you are arrested, sent to court banned on top of your existing period and the now added benefit of a criminal record..ordered to resit a test and it a lot harder than the one you took before

sort it man!!!!!!!
