Some fart crashed into me (nearly sorted)!!!

Basically this afternoon some old twat crumpled the front of my car!

I was driving down a small residential road behind "the culprit". He then stamped on the brakes and pulled over to the left curb without indicating.
So I pulled around to pass him and as I got level with his car he started turning right and drove into the front nearside of my car! I put my brakes on but didnt stop in time and he carried on going for an extra second or so after impact :mad: He hit me with the offside front corner of his car.

As you can tell I dont think I am at fault here but the other bloke was adament it was my fault.

What do you guys think?
Am I gonna loose my no claims :cry: :cry:

Worst of all the car looks a right mess! :cry: The wing is mashed, the bumper is totally warped and the front skirt is mullered :cry:

i would say it was his fault but its very hard to prove whether or not someone was indicating. very similar thing happened to me in my taxi, young girl did it, said she was pulling over to see if the car park on the right was empty before swinging accross, we ended up paying for the damage as her dad owned the hotel and was a good customer :evil:

you could try the old, 'he just pulled out from the parking space into side of me without indicating' its your word against his.

unfortunatley i can see this becoming a knock for knock though i am no expert :(

Sorry chap but to a by stander thats got to look like you've rammed him in the side?

You do get all kinds of idiots on the road, but insurance people are more likely to look at right of way before individual circumstances.

Where there any witnesses?

Knock for knock is what I would expect.
It was obviously his "fault", but you had just observed that he probably had no idea that there was another car anywhere near him, and you should have made allowances for this.
Was he pulling out into your path? Or were you overtaking and crashed into him? Depends who's eyes you're looking through!
No one was killed, millions of pounds aren't at stake, so the insurance companies will take the easy way out and blame both of you.

am trainin to be a driving instructor at mo (believe it or not) and have just referred to all the training manuals an stuff, basically hugh boring version of highway code,

technically you were inthe wrong for not making sure you had a fair idea of what the driver ahead intended
(not my worsd, reading from the book)

conversly, he was wrong for not checking his blind spot, mirros etc before changing position on the road,
(in my book far more wrong thn you)


i know all that makes little sense, but when did the rule book ever make sense :?

I would have thought that he should have checked over his right shoulder and wingmirror when turning right- as you are have to do to pass your test???. which he clearly didnt otherwise he wouldnt have hit me?

there was no damage to the actual front of either car. when we were stopped our front wheels were touching face to face

i would agree oakey, but as there are no witnesses and its your word aganst his, the insurance company will prob just knock for knock. i hope im wrong mate but you'll have to be preared for the worst.

Who ever makes the most noise / complaints / nuisance with the insurance company will win here!!!

Just say the other guy was parked up, then pulled out as you were passing him.

An old boy drove straight into my van last year, thankfully my van only needed a new indicator (Got £15 off him for that...) his Focus needed a new bonnet / bumper / wing / door...... some people just shouldn't be let on the road! but doctors will not 'take their independence away' by saying they are not fit to drive...

as brian said, at least no one was hurt.

may be worth explaining to the old git that its gonna muller both of yuor no claims and persuad him to keep it out of the insurance. may be cheaper to fix yourself than the increase in insurance :?

Chances are the old boy (By the way I am in no way ageist...) will have protected no claims, what ever happens it isn't going to hurt his pocket...

How long to you have to leave to have a fair idea of what the dricer ahead intended?

I cam to a complete stop before I went to pass him.
totally agree with you mate, the way its worded in the ol book, you have to check every mirror 15 times, get out ask the driver if hes thinkin of moving, run up the road make sure nothings in sight, ask the driver again, then very carefully proceed with caution whilst looking thru all windows at once, and so on...lol

can you tell how disallusioned i am with my chosen carrer allready winkeye

I may give that a go but i have given a brief description over the fone allready :o:

So if you are indicating and a bulb is smashed a fuse will be blown yes?

I had a crash that was near identical to yours in my e30.....

insurance decided to settle as no-one accepting blame (despite me saying i wasn't at fault), and i end up losing 2 years no-claims bonus....

I can only see this going one way!

You're going to lose or it's going to be joint blame!

Whenever you hit the rear of someone, it's nearly always considered your fault....even if someone pulls out on you on a motorway....

as it's down to your word against theirs!!!! :x

if you have had a good insurance history, you can ask them to review the case, they don't like doing this but if you put your foot down (no pun intended) they will investigate further. Alot of the time they work on just a quick resolution next case process, had two crashes neither my fault and stood my ground, got both accidents paid by other driver, even though in one of the accidents the other driver claimed afterwards he had a passenger who witnessed the whole thing, so now always carry a camera to show photo eveident of my car his car, and area. so spot the invisible passenger then.

If the indicator fuse is blown it proves that he was indicating at or after the time of impact, but an unblown fuse proves nothing at all.
If the filament of the indicator bulb is just broken it was not powered at the time the bulb was broken. If the filament has largely vapourised with white deposits, then it was lit, or has been lit since,
Unfortunately, since an indicator bulb flashes on and off, it could have been working at the time, and still resulted in just a broken filament.

they should. Its a marvelous example of german engineering.lol.
it was a huge merc that hit me. the only other car ive been hit by was a huge merc.
it was a similar crash except the rear quarter of my car was hit and they accepted liability.
