Instead of running the tube behind the dash would it be ok to fix it further down like in the pic ? I am worried about it coming down on my legs if in a smash ?

i personally would say a big no no, as if you have a front end it could crumple into your legs with the weight of the engine behind it putting you in a dangerous position. the general idea is to keep anytinhg solid as far away from your body as possible. it may be more work (i know i had to remove the dash for my cage), but it's worth it. you'd be suprised how easy it is to remove an reassemble anyway.
