Hopefully it is the latter.

Anyway I am going to collect as much evidence as possible+pictures and make sure I have got all my facts straight and try and build up a decent case for myself.

Thanks for all the help, I'll update this post when I actually get somewhere.

Cheers, Dan

Dude, take another photo from the passenger seat. That one is going to just make you look like you don't care!
Better yet, take a passenger and a video camera along and film the whole section.

not according to the angle of the bonnet, unless your car is LHD!

oh FYI top gear news reported today that 1million dirvers are 3 points from being banned and 17% of drivers have points. I would have thought it more than that. But I think I've just seussed the governments plan for reducing conjestion!

also £300 million has been raised from speed camera fines!

Ok I'll admit it I took the pictures :o:

In the last four years my licence has been 100% clean so I'm a bit annoyed that I've been careless.

I have nothing against GATSO speed camera's as every one I have seen has been in a sensible place where there is a history of serious accidents/deaths and I belive in most instances they do make the roads safer, however I have yet to see a mobile speed camera in a sensible place, they do seem to me like money making schemes.
but I know thats no excuse for speeding.

Thought I'd just update this as its been bloody ages.

Decided to plee with the ticket people to charge me for doing 73mph in a 60mph limit instead of going to court, anyway this was about four months ago.

Got a letter from the central ticket office today.

" Dear Sir

I can advise you that on this occasion I have decided to excuse the Notice. Therefore, no further action will be taken in relation to this matter.

Yours faithfully,

Ms D Rendle
Manager

Looks like I was lucky, never the less, I WILL be taking more notice of the speed limits in future.

Standard phrase used when they realise that they have messed up, and would be thrown out of court. It's as close as you'll get to an apology.

Yea well.. phew, I'll be able to carry on working to keep my license clean from now on.

Still does mystify me how the camera chaps seemed to think it was 40mph limit though, really is that obvious.. shows how little attention they were paying to the road.

if they have sent you some paper to fill out Jsut say your uncle came from abroad and was the driver at the time, for an address use one from abroad as long as its not anywhere in europe just make it up and send it off, a mate done that once before and never heard nothing back again.

thats ok except when its a forward facing camera and they have a good pic of you ....then it becomes perjury which can carry up to 7 years in jail .......and conspiracy to pervert the course of justice ...i know someone that did this they asked whose insurance he was using ..."he didnt have any" was the reply "so you let him use your car when you knew he had no insurance"......6 points and fine of £400 ...£60 costs...for permitting him to drive with no insurance ......then he wished he had paid the £60/3 points fixed penalty he got in the post...it doesnt always work in your favour.....

As some have said above there is meant to be a couple ways out of this, i dont know how true this is but i have a mate who works for trading standards not that his job has anything to do with your situation, but he reckons if you do not reply to the speed fine, after three letters they will give up, especially if the picture they took of your car does not show your face your in an even better position, there was something else he added but cant remember what, if i get hold of him i will let you know but basically he drives like a lunatic and reckoins he has got away with it plenty of times, i dont know how true this is or if he is talking out his :moon:

sounds like he's talking out of his ass to me.

I have a friend that took 3 points for another friend because the other friend already had 10. He paid him £300 to do it plus the £60 fine.

Turns out they gave the guy a driver awareness course instead of the points... Nice £300 bonus for my friend. winkeye

3 points and + £60.... i love it when they get it wrong tho. a traffic cop once got me on video from his car that was following behind me. he wanted to get me for 34 in a 30!!! but he didnt know what the road was called that hed videoed me speeding on! so he asked me?? i ofcourse said i didnt know and he wrote the wrong road name on the ticket, and because i knew it was wrong and he didnt, i refused to sign it at the road side. and i got out of it when i sent a solisitors letter asking for the evidence me. so despite the video evidence it really matters whats on the ticket. but if id signed the ticket that would have been a done deal for them! my mate also got a ticket from a fixed camera but with the wrong time on it, am insted of pm!!!!!!! and he got out of it!!! :D

I was prosecuted for doing 47mph in a 30 zone, however it transpired that the speed limit had been changed officially to 40mph although the new signs hadn't been installed. The charge was later dropped since the police were enforcing the wrong limit.

I was lucky, and in my own mind i would have expected to get prosecuted for doing 47 in a 40 anyway ... but apparently not!
Back in the dim and distant past when i was a motorcyle hooligan (my current wife has closed off that avenue of pleasure :o: ) in 1993 i was caught by a Lotus Carlton (black plain Pig car) on the M27 at 2am averaging 167MPH over 1.3 miles  I got away with a 7 day ban and £250 fine 8O

Far be it for me to say that the average Traffic Cop is thick but on the ticket they had written 12/6/93, half way down they wrote 12th July 1993. Spot the mistake, the Judge said that they could not prove that it was June or July 8)

I agree with all the advice given, you need proof or look for a technicality.

And yes it was a quick bike in those days, GSXR 1100 bored to 1260 (Not bloody quick enough to out run a Lotus Carlton though!! winkeye , god i miss my bikes, but i would miss my wife more, she would leave if i bought another.

If i remember rightly, they stay on ur licence 5 years but only count for 3 years.

almost sure they stay on your license for 4years after which you can apply for removal (some stay on for longer eg drink driving) ,but they only affect for 3 years under the "totting up"rules

Two catigories of points. One(speeding, careless driving etc)count for three years and can be removed after four. Two,more serious things like dangerous driving and drink/drug things count for ten years and stay for eleven.

To carry on the off/on topicness...

If points only stay on your licence for 3 years (my licence came back clean after 3 years when I applied for a photocard) why do insurers ask for convictions in the last 5 years?

Can they check some database that shows the points for two years after they were taken off?

If I have a clean licence after 3 years and tell the insurers I have no points, does that invalidate my insurance?

(Just pondering, its not a concern now as its been 5 years... but it would have been a concern a year ago!)

My understanding on this is that the insurers expect you to be honest with them.In the past I have been asked for a photocopy of my liecence when applying to a fresh broker.I would hope that the Data Protection Act applies here.I must confess that I regard points aquired whilst working as not counting toward private car insurance.....
