What year is the car ?
If it's on a k-plate or later (1993) it needs a cat exhaust to pass emissions tests.
If it's pre-1993 then you can fit a non-cat exhaust. The Lambda sensor can then be removed from the car, the ECU will operate in open-loop mode the same as all E30's without cats.

As was said on another thread, in most cases, as long as the car passes the emissions test, it should be ok for the MOT even without the cat.
