Won a strut-brace on eBay a week ago. Paid for it using PayPal, received it on Monday. When I say it I should say them because they sent me 2, in separate boxes. I've checked with my bank in case PayPal has paid for 2 but bank says as yet nothing has come through from PayPal. Been told to wait till end of week to check again. Have not asked eBay about it or PayPal. Seller has not contacted me about it. So what do I do now? If I've only paid for one I'm inclined to keep it, and sell it to someone else. Or am I just being a greedy bastard?

Just be careful that they don't decide to take out the payment for the other at a later stage...they might realise their mistake and try being crafty about it...But if they don't....RESULT

Yeah, sounds like dishonest appropriation with the intent to permanently deprive. Theft Act 1968.datourer wrote:Well, if you don't send it back then it's no different from stealing it. Just my view

it is not strictly theft as it was not dishonestly appropriated, although there is an intention to permanently deprive as per sec 1 of the theft act as pointed out by Zayyan.
Is is analgous to the situation of finding a nice lump sum has mistakenly been deposited in your bank account, you go out and spend it and then the bank realise their mistake. Bottom line, you would owe them the money back.
The decision is yours really. Prob best to wait a while and see what happens.

Don't you have to tell em, then they've got 30 days to collect it before it becomes yours (or something like that)?

Probably better if you tell them that you have it and ask them to collect it. You have no obligation to send it back yourself, its up to them to sort it out - but you've told them of their mistake.
Next thing is to ask them to give you 24hrs notice of their arrival (a reasonable request I'd say) and then you've got time to remove it from your car before they they arrive
IF they ever do.....
If I was running that company I'd be more concerned with fixing whatever loophole allowed a double shipment than with any single shipment itself.

Don't tell them, see what happens, if they get in touch regarding it a few weeks down the line, just say you were working away or something and your wife, partner (whatever) took delivery but had no idea what it was so they' both still in the box, if they've not been in touch in a month I'd say you'd gotten away with it.
Theft, maybe it is, but in this day and age it's look after number one I'm afraid....

i say keep it, and see what happens. if they dont contact you, then you're wining!! and even if they do contact you, deny everything like it never happened!!! after all, what kind of respectable company would do something so dumb!!!
at the end of the day, they cant absolutely prove that they delivered two to you, and they dont know if its in your possesion or not, so f*ck it!!!
i know what i'd do...

Have checked both my bank account and PayPal, and only one payment has been made. You guys have echoed both sides of my conscience, one side says keep it and the other says own up. The reason why I'm inclined to keep it is that the seller has, or so it appears to me, been creating false bids on the strut-braces they have had for auction. There have been a lot (27+) of these braces for auction from the same seller over the last few weeks, and I've bid several times and been outbid by the same few bidders. Their bids seem to top-out at the same level on the last day of bidding. These bidders have mostly neither given nor received feedback. Obviously this is just my opinion, but it does look suspicious to me. I think what I'll do is wait and see if they get in touch, and take it from there.
The brace looks OK, and took less than 10 mins to fit.

Dude keep it! It was their mistake. If they then try charging you for a second brace just say you only received 1 and what the funk are they on about.
They can't prove you got 2. I should imagine you had to sign for them but its probably the same note as if you were siging for just one. If I'm wrong then ignore what I'm saying but otherwise don't feel guilty about it. This stuff happens, some times your on the good end and sometimes on the bad. Make the most out of it while your on the good end I'd say. I hope I dont sound like a dishonest person because I'm really not, however I do like to optimise in certain situations.
All this being said, was the seller an individual or a company? If its a company, they can afford the loss however if its an individual who's been a pretty decent seller and given good communication then I'd probably take back what I previously said.

It happened to me once on a DVD player, I just kept quiet and sold it after a few months
.
Unsolisited Goods, legally you should notify the company in writing to collect, if they dont collect within a month they are legally yours.
Personally, i would keep hold of it and play stupid.
