As many of you know, last year on oct. 26th, i crashed my first Is due to a women pulling out on me at a set of lights in heathrow. I was going through the middle lane, the light was green, i have two witness in the car, and two outside of the car, that both say it was her fault and that she should not have pulled out. Even after i got out to see if she was ok, she said sorry and things like that. Her car was so mashed we couldnt even push it out the way. Anyway, when the 5-0 showed there ugly muts, she then kept saying i jumped the lights an it was my fault.

anyway, after forking out £250 of my own money on the day to get the car towed home, i rang her company who advised me to make a claim through my own insurance. Not only was this impossible because im TFT< but also fookin cheeky in my opinion. Someone on here put me in touch with Lee, (e30beemerlads) solicitors, an they have been dealing with it ever since.

Basically, iv been ringing up every two weeks to see if there has been anything happening. I have visited a specilaist doctor regarding my kneck as it was fairly stiff for about 6-8 weeks after the crash. On top of this, my car was written off as a Cat C (luckily i kept the parts and made enough to buy a new is), and i was told i would be given £610 for that. Despite this, the third partty has still not admitted to liability, despite there being two independant witnesses testifying against her.

Its now got to the point were iv been told its going to the courts because liability wont be admitted. What bugs me is we pay ridiculous insurance premiums each year, hardly ever use the fuckers, then when it comes to needing them theyr fuckign useless!

Sorry for the rant, but its gone too far. i now have to wait two-three months before i can even get a court hearing date. im completely poor, and i know i cant just fall back on the payout money but thats not the point. I owe two decent people on here sums of money, which they will obviously get in good time but all the time i have to pay insurance, tax, and university fees as from september, its just getting ridiculous

Just thought id warn you guys, iv you ever crash an its not your fault shaft the person for all you can get or you will get screwed over BIG TIME!

ps iv got her address winkeye

Hey I'm sorry to hear about your insurance,

I had exactly the same problem, someone pulled out when I had a Corsa and he thinks he had right of way to pull out, which he didn't, he crashed into the side of me and then he admitted fault.

Long story short, it took him a YEAR and and threat of court appearence to pay up, 700 quid :D:D then I bought my mates 316 hehe.

Get in touch with the DAS they were pretty helpful for me.

Insurance companies are thieves! Simple as that.

A work collegue of mine has just won a court case were someone drove into him at a roundabout (not his fault). He had a witness, but the other driver tried to say it wasn't his fault. All ended up in court about a month ago and he won, the other driver didn't seam to be that bothered. My collegue assumed that it was the insurance company just wanting to try their best not to pay.

This took nearly 4 years, and he had to pay higher insurance cost pecause a pending claim for that period, which he has now got back today.

Its a gravy train, its good for both the solicitors and insurance companies to bring it to court, both make money from it.

Basically they are waiting for you to give up, DON'T what ever you do.

Took me nearly 3 years to sort my crash out.

Someone went into the back of me on a dual carraigeway i was waiting to turn right across the oncoming traffic he came round the corner and hit me.

His story was all over the place, my total amount to be claimed back was just over 9k including 2k for compensation, his claim was capped at 3k.

Went to court the judge agreed with my version of events but wacked it 70/30 in his favour cause he reckons that a combination of him not looking and me apparently turning where i shouldnt of been it wouldnt of happened.

In the end i ended up with about £600 cause 30% of 9k is alot more than 70% of 3k lol

By the end of the 3 years it took i was just glad to get it over and done with i just wanted to judge to agree with my events of the way it happened and he did so i was happy either way.

Just a pain it was drawn out so long its just the way the cookie crumbles aint it.

Who cares? You go to court with witnesses. You win. The End.

In my experience insurance companies will go to court even for the tiniest bump if no party will admit liability. If you have enough evidence that it wasn't your fault there's not a huge amount to worry about to be honest.

Apart from the fact that it may take years and in that time you may have to pay higher insurance costs.... Court it self isn't exactly a nice experiance (unless your a lawyer and all you can think of is thte money...)

ride with it dan, go back the doctor, say you neck still hurts etc due to accident, and just keep persuing the claim

i did, i chased them for 4 years, thay kept denying liability and there were no witnesess,

they kept coming out with offers, very good ones, but claimed forr more and more and eventually 2 weeks befor it was due in court they settled at £9000,

including a car i paid a £1000 for
loss of earning for 2 months, back pain and suffering, physio costs, tranpostation cost for the time i had no car, un insured lossed eg base box in car with amp and i damaged a sweat shirt in tha accident and i even claimed for that!!

it worth persuing mate, let you insurance copmany do their job, if you can take an interim payment for the car and recovey costs and then persue the injury claim

As long as the witneses don't back out you should be fine just keep racking up the cost's and let the judge deal with it, there's not a lot else you can do now someone's told the silly cow to fight it.

Exactly my point. If your description of the accident is correct then with the evidence and witnesses you have it's undeniably her fault, and no reasonable court will conclude that it's not.

Plus re court not being nice, do you even have to speak? My insurance company said I don't have to and someone will do all the talking for me.
