I do own a 316i with a factory fitted tech II kit - a laguna green touring, but it has a standard exhaust.
The only difference between exhaust fitting arrangements across the whole E30 range is the cut out in the rear valance and the tech II kit that covers it. Models with twin tail pipes have a wider cutout to suit.

So I can buy a scorpion exhaust and it will be a straight swap with my 316i standard backboc exhaust

If it's sold to fit an E30 316i/318i, then of course it should fit, otherwise it is being sold "unfit for purpose".
A problem that might arise is one that often occurs when a non OE rear box is fitted on an E30. There are two supports for the exhaust that fit to clamp bands around the rear box. If the box is not the same cross section size as OE, then the OE bands won't fit, so make sure you obtain ones to match the new box.
