3rd brake light not working is an advisory not a reason for refusal. If fitted AND connected then must work, if fitted and not working the tester is to assume it is not connected. (seriously, check the manual notes).
If half the bulbs work and half don't then it is a fail, if the whole thing is out then its an advisory.
