I sold a spares/repair E36 towards the end of June.
Chap paid.... Bank transfer
We are not talking a lot of money here £295.
He has not picked it up yet despite calls/texts
He also does not want me to put the log book on his name.
So I am stuck with a car. SORN with MOT running out and now has a flat battery.
What is the legal/ethical thing to do?
Advice please (not just Pacer)

Give him a deadline to collect it, or you'll either sell it on or scrap it, or charge storage charges as appropriate.

Tell him unless he picks it up by X date you will report it as an abandoned vehicle to your local Council and he can deal with them.
Hopefully he won't work out the problem with that idea.
Edit: Mr Speedtouch beat me to it.

In addition to this, advise him that the log book transfer will be made to him on the scheduled date..!Speedtouch wrote:Give him a deadline to collect it, or you'll either sell it on or scrap it, or charge storage charges as appropriate.

I think he wants to put it on his name when he collects it. Currently not happy as I can't use it and its in my way.steve_k wrote:^^^^^^^^^this,Gert_8 wrote:In addition to this, advise him that the log book transfer will be made to him on the scheduled date..!Speedtouch wrote:Give him a deadline to collect it, or you'll either sell it on or scrap it, or charge storage charges as appropriate.

My guess is that the enthusiasm or need that he had for the car in June has now run out, and he's lost all interest in getting the car moved. He's hoping you will decide what to do, and in the case of it being shifted on, hoping to get his money back, at least most of it. Send him a text saying that if it is not shifted by xx date then the car will be sold as salvage on his behalf, and thats the amount that you will refund. Unless you hear from him, that is what will happen. I'm afraid you will need to give him another month, with reminders every few days of how many days are left.
He doesn't want the log book in his name because if anything goes wrong, he gets caught on the road etc, you will be the one who gets the letter from the DVLA, not him.

Maybe the cost of having it collected is more than the cars worth, so he's left it.

F0000k the freak (he will be !) Get it on ebay, 3 day auction. If you are feeling more than charitable, give the loser the proceeds as it is effectively his car. Obviously you keep the £295 that he paid you to buy it off you. I would also subtract a decent drink for your time and aggro and ebay fees. He might end up with the price of a Happy Meal if he's lucky
PS list it as spares or repair in the parts section, = no listing fees.
