Hey Rich,
I went through something similar recently where a lad drove straight into the back of me whilst I was stationary at some traffic lights.
It seems like you have a good case to find the other guy liable for the accident, which you want to fight for as then the claim will go through his insurance and leave yours untouched.
So really you need to try and find out if he was insured one way or another, but I'm fairly sure that if he doesn't have a valid driving licence it would render his insurance void anyway.
You will be asked to get your car assessed by either your insurance co. or his, and then they will determine if its a write off.
If it is written off like mine was, they then should give you a chance to buy it back. Mine cost me around £180.
Now you have the game of getting as much money for your car as possible from the insurers. The bastards will almost definitely start with a low blow like £800-£1000 or something. Obviously, refuse this straight off.
Its worth having a look for cars similar to yours that are for sale and noting down where you found them, or even better which is what I did, email the insurers the adds as proof of the going market value.
You may find you don't have as much trouble as I did to get a good price as your car may be in the glass's guide which most insurance company's use to get the market value. Mine wasn't (M-Tech 1 Sport) and I had a hell of a job.
After lots of pissing around talking to the manager and insisting on an independent assessment I finally got £2300 for my car which although I still wasn't too happy with the insurance company wasn't budging any more.
Lastly I would strongly consider whether your neck is hurting or not. My injury claim is what bumped my repair pot to a reasonable amount!

A little update for anyone who is interested. I am dealing with it theough a accident management company, who i cant really decide if they are being more of a hinderance than a help. But basiclly im without a rental car now 5 days on, because they need to establish if he was insured and through who, but odviously as it was a hire car he was in and he hasnt got a license, this isnt appearing to be as straight forward as i thought it would have been. So the only way i might get a rental car is by having to go through my insurance! Aswell as, the little runt has returned his car and told the rental company i went in to the back of him, so now they are going to be trying to do me. He trying to wiggle his way out if it because hes odviusly realised hes out of depth now that he hasnt got a license etc. Its really getting to me now all this peeing about. Im the victim but yet im the one suffering still.

Had this type of thing happen to me a few years ago, was driving down the main rain in the town where I lived at the time to go see my GF after her dad had died& all of a sudden the carwash it in the side& pushed to the side of the rod & up the curb,

Raang my GF & told her what had happened & she came straight over, went into mo e & got my insurance papers. & when I came out the doctors made sure I rang them,

A few weeks later (after the other driver had been charged with drink driving, due care & attention etc my insurance firm rang me to say that he claimed I had gone into him despite the report from the police & 4 wittnesess stating otherwise, spent 2 months after that arguing the toss after the car was written off & I had been paid out,

After that a lawyer rang me to say the other driver wanted to sue me for the damage to his car & for making him get a 2.5yr ban :eek:

Safe to say that after a few call's to my step dads mate who's a QC they dropped it.

Even now 5yr's after the event when ever I see him he still claims I ruined his life.

There really are some idiots out there, just make sure you get plenty of legal advise to make sure you know where you stand.

Yea diable. Reported him to the police. They attended on the day it happened. But by the time they got there he made a bunk so i knew there was something fishy because he was in such a hurry to get gone, and the fact his car was still deiveable but yet he got picked up someone and when he was on the phone to whoever it was that picked him he sounded panicy! Then when old bill did finally turn up they wernt with me long, i just gave them his details, they didnt get out the van or ask me much, they just said they would see what they could find out, then about 20mins later when i was still on my way home they rang and said he hasnt got a valid driving.

I know that he shouldnt have been on the road without a license, but my worry is that one way or another he was and how this is now going to effect.

I know this aint going to be straight forward, and got a feeling its going to be proper long winded and not sorted any time soon, especially now that hes saying i went in to the back of him, aswell as the fact its a rental car and the no license bit.

You think the fact that he left before the police came, even though he knew that they were coming, the insurance might think it was a bit suspicious on his part, and why would he have go if he was innocent and had nothing to hide, and it might go in my favour?

Yea steve k, well the whole reason i wanted the old bill to attend is because i suspected he may have been drinking, but by the time they turned up he had gone, so odviously didnt get breathalised, and the didnt breathalise me, even though i would happily have let them, as i hadnt been drinking and had nothing to hide

The world of claims can be very messy.

If you are dealing with a claims company (not all are that great or bright), you may need to point out that the driver did not have a license but was driving a rental car and the rental car will be covered by a fleet insurance and this is how you will be claiming from and You should advice them to contact the hiring company as it is also illegal to rent a car to a non license holder. I am sure they will not want it to get that messy.

Yes fastroad, i have told my company that is dealing with it, that the police have told me he doesnt have a license, but now also the rental company have sent my claim back to my company and rejected and said that the bloke has returned his car and said to the rental firm that i went in to the back of him.

Because the guy did not have a license they have no leg to stand on and the guys story will not hold as he has already lied on more then one occasion.

You have the copy of his rental agreement and the police have a record of speaking to him so that makes the hire company at fault for letting an uninsured driver access to their vehicle and as it seems like it must be small rental company and they may try to change the driver details, keep an eye out for this.

And magpie, your not trying to imply that there is a chance he could get away this are you? I mean surely not? I have witnessess, police reference number, his details, he fled the scene, has no license, he jumped a red light, its clear the damage was caused by impact from his vehicle to mine.

Well now, apart from being a sad old b*st*rd, I was born just around the corner and I'm sorry to say that I remember Hook Road before it became a dual carriageway. Also went to school at Southborough (Ace of Spades). :)

That's the most important bit, keep hold of the car. if it goes to a body shop or storage yard that's the last time you will see it. Also ask the insurance company what the policy is for buying cars back, tell them all the time and money you have put into keeping the old car in perfect working order.

Rich, sorry to hear about your dramas :( As the boyz have said, DO NOT LET ANYONE TAKE THE TURD !! The other car / driver scenario is suspect at best. Was the Enterprise rental agreement in the name of the guy whose details you have ? Or was he driving a car rented by another party ? Either way, without a license, I cannot see how he can be insured ? :? Did you take pics of the car , the damage and the driver ? Best of luck, it sounds messy :(

I should have all the bits to repair it, including a lump of inner wing if needed. If you need a proper receipt for the fine chariot specifying the spec / morsels etc just give me a shout :)

The only way he can be listed on the rental agreement without them seeing a license is if the car is on a corporate deal. I did a years work experience for them so if you scan it in I can offer more advice.

Funnily enough I have an enterprise car at the moment as someone hit one of our company cars. As it is an insurance non fault rental car and on our business insurance the only people that can drive it are the people who have shown their license at the enterprise branch.

From memory the form that the enterprise worker has to fill in has a place for the driving license number which is compulsary. It cannot be skipped. If the car was on a corporate deal this is not required. But you said his name was on the rental agreement...

Are you sure he didn't give you the details on the rental agreement and he is actually someone else.

By the way. Talk to enterprise. They will probably be quite helpful. They do not want to be paying another company for a small prestige car for X amount of days. With complex write offs where value is 'debated' this can drag on for a couple of months. Enterprise will not want a £85 a day car billed to them for 60 days when they can give you one of theirs for not a lot of loss to them.
