hi is there anyone out there legally minded i have an e30 cab being sprayed since june the guy is an ass he wont put the car back together keeps messing me around i have paid him for the work but i just cant get my car back from him i have been to the police but they say its a civil matter iam at present taking him to court to get my money back but the say they cant do anything about the car can anyone please help me out here

Get a few good mates together and go and take YOUR car back.
Youd be better either putting it back together yourself or pay someone else to do it before HE sells/scraps/damages it!
You can still take him to court for your money

yes done all that and he is still trading will do anything at this point to get my car back legally mind though

Contact your local Trading Standards for advice. Dont go to the CAB because they'll give you the wrong advice as they are not qualified!!

I wouldn't wrap a baseball bat around his head just yet, await until the court case is over.

id just go with a trailer m8 & pick the car up with some big lads put it back to gether your self then if your still taking him to court charge him couple of hunred quid for putting the car back together.ive had to do loads of some one elses jobs. i work in the body & paint trade bet he cannt remember were things go.9 times out of 10 when you get it back there will be things missing good luck m8

i spoke to trading standards recently with a similar problem, they advised me to send a letter to the garage stating my grievances and informing them that i was prepared to give them 2 weeks to finish the job, then i would be taking the car back wether it was finished or not. as long as youve not refused to pay for the work done then the garage cant stop you from taking your car or get the police to stop you.it is a civil matter and the police only step in if if a criminal offence occurs .the problem is as youve already paid hes got you by the balls unless your prepared to pay extra to get some one else to finish it. and you would struggle to find some else prepared to take on some one elses half job.

i know hindsight is a wonderful thing but can i ask why you paid the full amount up front? as hes had the cash and spent it long ago theres no incentive to finish it, maybe its time for threats if nothing else is working.

Terrible matter - best of luck with it! Once you get the car back, a little letter to the local rag sounds about right.

thanks for all your replies ian living in ireland at the min, i paid him in full as he said he only had a couple of days left he was recomended by a friend so i trusted him never again though iam going to try and go around today with the police and get it back i will let you know how it goes
