I'v got my e30 tech 1 up for sale and just had 2 indian guys turn up to buy. Heres the full story. . .

About an hour after the ad going live on pistonheads, he called asking to put £100 deposit on it. I agreed and said i'd hold the car for 2 weeks. He also asked for me to mot the car, which I did. He also asked for lots of pics etc which i'v sent.

He turned up with his ''lawyer'' friend to view the car and left around 20 mins ago. He had a good look over the car and he was a little put off by the rust but because I love the car, kept to the price I wanted. He then noticed the vin numbers didnt match and I suppose, due to the shock of finding this out, I failed to check them while he was there. I also couldnt find the v5 after hours of searching for it (even though it is somewhere) So he reasoned that due to my car being a ''ringer'' and due to the fact it had no v5, He should have it for a lower price. I discussed it with my girlfriend and she agreed a slightly lower price. This guy wasnt happy with the lower price so demanded his deposit back. I refused saying that i'd lost just over a week of potential sales and had to mot the car which I wasnt planning to do. The guy got aggressive and started to threaten me. I still refused his deposit back and said i'd get the vins checked by bmw and find the v5.

The 2 men eventually left. Once they'd gone, I thought i'd check the vin numbers as i'd done a hpi check when buying the car. Lo and behold they match!! The guy was trying to swindle me to lower the price.

So first of all, does anyone know this guy? Around 35 - 40 years old, indian/asian, around 5'10, medium length black hair, stocky build and from liverpool. Secondly, do any of you think I should refund his deposit? After all, i'm out of pocket for the mot and time the car was held for this guy to collect it.

Sorry for the essay but it's really annoyed me and i'm now worried about the security for the car.

You're not out of pocket for the MOT as you can reflect that in the price.

I'd keep the deposit for your time being wasted, might also teach the guy not to try and swindle the next person.

Deposits don't get refunded, that's the point of them. They're security for BOTH sides, not just one, especially if you've agreed other terms (such as putting an MOT on it.)

If he got aggressive though, it might be worth either keeping the car garaged or storing it somewhere else for a little while, until the guy cools off. You might also want to contact the local police and see if they have any history of this guy, or similar scams. It won't help you now, but certainly if you tell them, and THEN the car gets damaged, you have a very strong case on your side.

Cheers all, appreciate the support. The cars behind security gates now so they cant really do much. I'd have been so pissed off if it'd got sold on the basis the vin numbers were different. As far as i'm concerned now, I have his deposit and I can relax and know my car's genuine!

Urm....how did he check the VIN number against the V5 if it is not present.....and more importantly, why would anyone buy a car without a V5.....and why would you even consider selling a car without a V5. I travelled to York last year to buy an E21. When i got there, the owner did not have the V5 (Did not tell me before i left) I took the coach back and went through small claims court to get my deposit back. I wasnt prepared to take another day off work, spend more money on train fares to pick up the car. I got the deposit back and all my £268 costs + my £200 deposit
I'm sorry, but No V5 then no sale and no deposit. Simple.

Sometimes they get lost/mislaid. I bought a car without the V5C. You can apply through DVLA for a replacement. V62 form if I remember correctly.

....but how do you prove he is the owner of the car. I'm sorry but if i am going to buy a car, i expect the buyer to have everything ready before i get there, instead of looking for it when i arrive. I'm sorry but i have wasted time and money on this very situation, no way will i part with my hard earned cash unless i have the all the documentation for the car before i drive away. 8O

The seller is saying the VIN numbers do match, the buyer is saying they dont match....and there is no V5. The VIN number situation is very simple. The untampered number on the bulk head should match the untampered VIN plate which should both correspond with the V5 document. If anyone of these links in the chain is broken, i'm sorry, as far as i am concerned the deal does not go ahead.

apply for a copy reg doc, keep it safe (with the history/service record/receipts/handbook for the car) with the new MOT (always an excellent selling tool).

you had plenty of time to get your paper work sorted!!!! dont know how far the little fat micky mouser came, BUT, its down to you, no one in there right mind would buy a car without the V5, is it worth the hassle of courts or what ever, just wash your hands and put it down to exsperience, funny way to spell it, but you know what i mean :mad:

I do see your point mobster but I KNEW where the v5 was and then my missus has tidied it away yesterday, I offered to bring him into my house and show him I.D to prove I am who I say. It is also not a legal requirement to sell a vehicle without a v5, it is only illegal to fail to notify the dvla. Plenty of cars are on pistonheads or go through auctions without their v5 certificates, they dont prove who is the legal owner, their only purpose is to make it easier to inform the dvla of changes.

I will of course be sending off for a replacement form asap and searching the house top to bottom again. Also he claimed the 2 vin numbers (the one below the windscreen etched into the metal and the one by the drivers headlight) were different. I was shocked and had a million things racing through my head as to why they didnt match.

As for a small claims court, why should I (as the seller) be responsible for this mans travel arrangments? I advertised the car fairly, he just wanted to pay less and hoped that by lying to me, I would drop the price to get rid od what he called a ''ringer''. I could understand it if I called the car ''immaculate'' and it was a shed but I told him of every problem I know of. The car is up for £800 so he knew it wasnt immaculate, the parts alone are worth more than that!

golfman, you can not expect someone to buy your car without a V5 document. End of story. Tidied away, the dog ate it, its in the post are all excuses that people dont want to hear when they have travelled miles to buy a car and then you cant produce the V5 document for the vehicle. Ok, things do get misplaced etc, i am not denying that, but then for you to withhold the mans deposit becuase YOUR girlfriend lost the V5 document, well.....i think there is a serious morale issue here. Your girlfriend lost your V5 document for the car you are selling and the buyer is loosing his deposit becuase of that.

I have been in this very situation where the seller could not produce the V5 document, and i won through the small claims court so do yourself a favour and give the guy his deposit back after all it was you that could not produce the correct documentation !!!

I knew it was only a matter of time before a b1tch like you would turn up,
For your information the car vin plate had been tampered with, without a logbook there 's no way of telling if it was a Sport or a basic 325 or even a 316.

And for ripping a zoner off, i dont think so, sold many item's on and off the Zone and not 1 complaint.
