EDIT: I would NOT advise removing bits unless they are bits which are hidden, otherwise it may look dodgy when an assessor comes to look at it. It may look like you are covering something up like mods not declared or hiding damage which implicates you.

1- Take pics of the car as it is
2- Take pics of the junction where the accident happened, showing your approach and showing her approach. Also sit there for a while and take notice of the sequence of the lights and record this, video it if you can. This will help to support your argument. Could it be that the sequence of the lights could not support her allegation?
3- Were you approaching the lights on green or were you on red and pulled away? In my experience, it is a better argument to be the person who says they were stopped and pulled away on the change to green (you'd hardly sit there on red and pull away still on red)
4- Did anyone stop as a witness? Was it near a petrol station or shop where a member of staff may have seen it? Ask around? A witness to support your allegation that is independent will help no-end.
5- If it ends up being your word against hers then it could end up being settled 50/50, meaning you get 50% of the value of your claim from her insurers and she gets 50% of her claim from yours.
6- Write down a detailled description whilst it is all fresh in your mind.
7- Where was the damage to her car? If you stoved her in the side near the centre or to towards the rear 1/4 then you are more prone to getting stitched here, if you caught her right on the front corner then you are better off.
8- See how your neck feels in the morning
9- Have you spoken to your insurers, best to as the bullshit she is peddling means she will already be making a b-line towards your insurers, so they will need to know about it anyway. If you have legal cover they will point you to their solicitors who will put the boot in with her insurers and a month or two of fannying about will ensue before either side will settle on a liability position.

Just PM me or email me at work lee.jones@corries.co.uk if you need anything doing or explaining, happy to help

Thats crappy luck mate - however, you can look on the bright side, if the engine is ok, you can look for a new motor, swap your good bits over and then flog bits you dont need like the engine which you should get good money for seen as its an iS!!

Hope the claim goes your way. Were there any visable skid marks that you could photo to proove speed and breaking distance btw??

My mate had an accident in his first car of 2 months and related with a Volvo (TANK). Turning right on a mini round about and she came right across the front of him, just missed the front of his motor but he hit the centre pilar of the car.............OUCH!! She blamed him for going round the roundabout first when he had right of way  and she wrote his car off, even twisted the roof 8O

Hope you feel better soon mate, be good to meet ya at Ace

top tip for any of you after having a car accident, don't move the car if you can get away with it, take somre pictures of the vehicles in their resting positions, showing the damage, where any debris is on the road, skid marks etc. If you don't have a camera phone, then invest a couple of quid in one of those disposable cameras and leave it in the glove box.

Having photos of the accident scene counts no-end. It is a much better bit of evidence than your word against the other motorist. If Dan did not have a witness for this accident he could not prove she went on red and vice versa, meaning the lad would probably have to cop for 50% of the blame.

"It's not what you know, it's what you can prove"

Also, call the filth and say you are injured, that way the police turn up and take statements and sometimes draw diagrams etc. If you don't say you were injured they don't turn up, alternatively say you can smell booze on the other driver, usually gets them to drop their doughnuts and come out.

i was going to take photos but the witness in hand ran over an said i have to move the car in hand, it was right by a huge junction in heathrow at 5pm doh!

shame its dead but hopefully even if i only get a small payeoff i can buy an is that doesnt need a paint job and that doesnt have blocked heater matrix pipes, and jsut bolt on all my mods so far

never thought i would be modifying a car so that it is standrad!

beemer lad deserves a shout here top bloke well helpful

true zone spirit yet again!
