To cut a long story short picked up 325 on friday running like a bag of bones.
Took it back sat morning before op on finger,windscreen wiper was scratching glass,new steering wheel not centred what did i pay Ԛ£1100 for.
Scratchs and dents that where not on the bonnet when i first bought the car i only had it a week and its been in the garage since but was not sure.
I then checked the photos that the guy took on the day which he sent to me and guess what there is not a mark on the bonnet and i have proof.
What do i do where do i stand i just find it so hard to ring up and tell him what i think because i kind of know he now with my car being there so long its tricky.
Any advice welcome. :cry:

trading standards mate, and get a letter, legal aid, big mates with bats, anything, if u have the photos, itԚ´ll be harder for him than just his word against yours!

deffo have a word with him, and tell him straight. worst is he wont do anything but its better than walking with uԚ´re tail between your legs. and u can always break in or burn it after (if heԚ´s that dodgy he wonԚ´t bother having insurance) :evil:

Thats just it mate the guy is a bmw specilist not a micky mouse outfit thats why it does not make sence at all,simon will tell you my car sounded bad on friday night and that was just over a mobile phone.
The whole top end was supposed to be done why do i get the feeling thats i am being shafted some how.I bought a 318is clock set up to replace the 325s own as they said they could not fix it.The car was running at a 1000 rep.He said it was because of the clock i thought they where all the same.

He's right that the clocks different, 4 cyl 6 cyl engines, need to change the coding plugs on the clocks.

Trading standards are your best bet, sorry to hear of your misfortunes.

ultimately trading standards will tell you to get a solicitor, you only have some remedy for misrepresentation only if the seller does this as his business, the car may be secondhand, did you have a chance to inspect the car as it was before the sale or did you buy it without inspecting it!

I would say speak to the specialist first, get the run down on the solution. If that does not work, then trading standards and a solicitor might be the next course of action.

Are you a member of The AA. I have been a member now for 21 years and admit that I have only used them 3 times!! But, knowing that If I have a problem with A CAR, as I am the one protected not the car, whether mechanical or contractural, I can use them and get technical help, legal advice etc.

How did you pay the specialist, if you paid by credit card, then speak to the card company and get their legal advice too! They could stop his account if he is found to be negligent!!

Legal success is only likely if the issues/problems are making the item/vehicle not fit for the purpose

Your not going to get anywhere re the paintwork im afraid mate, unless its a goodwill gesture by the garage

What I will say is it is very,very easy to overlook things like scratches, dents etc at a first viewing of a car...Its usually after youÔš've first cleaned/polished the thing..Then its "that wasnÔš't there when I bought it, was it?!!

Photos are not good enough to base a judgement on

For what its worth, heres my experience...

March 2003, pick up a BRAND NEW Kawasaki ZX9R, paid for the day before by electronic transfer....I ride the bike off the forecourt 200YARDS to the petrol station, notice a dirty mark on the tank...

Dirty mark turns out to be quite a nasty chip and dent...

Take the bike straight back to the dealer (Wheels International, Hockliffe,Beds -just for reference!)...

No sir wasnÔš't us sir......

They just werenÔš't having it...I took my complaint down every avenue, emailed all the consumer groups, MCN..

In the end I got them on the local radio consumer show..They then made a "good will gesture"

Its a hard call to make i am not worried about the engine because i know he will put it right.Its the marks on the bodywork that needles me as i am 99% sure they where not there but i could be wrong DENT MASTER HERE I COME.Is not worth the hassel i will only end up falling out with the guy you never know when i might need advice or something.He has only got Ԛ£600 of my hard earned at the moment as i had no place to put the 325i on friday night untill my mate takes the IS of my hands so i gave him 6 and he said i could keep the IS at the garage and take the convertible he also wanted the IS. Things have changed now as my alpina has been sold and goes on friday[sad but i could not keep em all]but i do get to keep the IS :D Has anybody had any dealings with ATRIM gave em a ring during the week regarding doing my leather on the convertible its not bad and its not good no rips or anything but just tired.To buy a second hand one will cost Ԛ£500 and it wont be the same colour and wont be perfect.
They will do mine over again same colour and to factory spec with extra padding for Ԛ£750.
Total price of car Ԛ£1500
Travel expenses Ԛ£100
Repair bill Ԛ£1150
New leather Ԛ£750
New bumper nothing wrong with old ones its just me Ԛ£60
Odds and end Ԛ£100.
Plus minus then the car would have cost me Ԛ£3500.
Still reasonable for a convertible beause it would then be perfect with nothing to do.
