Interesting... I've just won a Sport on Ebay for Ԛ£1320:

Only thing is, I went to look at the car today, offered him Ԛ£1500 and he said "no way", as he had someone else coming to look and besides it owes him MUCH more.

"You won the item!" said Ebay. Personally, I suspect not...

if you won it for 1320, you give him 1320 . not 1500 !!!

complain to ebay directly and lodge a none selling seller dispute.

Get ebay to sort the guy out. Things like this are happening all too often now... it's upto ebay to enforce there trading standards.......

Whoa, there fellas.

Benefit of the doubt, I don't know what's happening yet. I just suspect that when I contact him, he'll have "forgotten" to cancel the auction after "selling elsewhere" or something.

I may be being too cynical of course. Could be I have myself a bargain.

went to see it, offered 1500 to end early, refused, went home, bid what he bid and it ended at 1320. i guess.

whats confusing about that?

The way it is typed suggests that he won the car, THEN went and offered more, THEN he said he hadnt contacted the seller yet.

Well if its in good nick it is worth more than that, but as he says 'no reserve'

He was probably thinking it would go for more right at the auction end, and if it had been advertised properly ie. listed as 325i sport instead of 325 i sport and with proper description and pics it might well have

As it is you should have won the car fair and square

Thanks Toby, that's right. I went to view the car first, he wanted an offer so I said Ԛ£1500. He said no, but mine was still the highest bid at the end (i made a bid of Ԛ£1500, but wasn't expecting to win, just put myself in the running in case he had trouble selling).

Anyway, he doesn't know it was me, yet. I suppose I'd better "reveal myself" and see what the game is.

ebay won't do sh1t

get someone else to go test drive it, ask to look at the v5, get a solo test drive then drive the damn thing home and paypal him the 1320

sounds harsh but he won't have a leg to stand on if he complains to the police

Right again, Toby - Ebay won't do sh1t. It's just taken me half an hour to find a link to their support...

I'd like to do as you suggest, but I don't fancy coming across him and his Asian Gangsta mates late one night. Besides, he's too canny for that; all that "selling for a mate" business is BLX - he's a dealer, you won't get a solo test flight.

Pisses me off, though, it's just what I'm after.

What I will do is email any bidders with the sorry tale, then when it doesn't sell... it's MINE.

You actually have the right to take it to court as he's entered a legal contract to sell the car to you.

If you really wanted to you could make him sell that car to you as you have succesfully won the auction as an auction is a legally binding contract.

Tell him that unless he sells it to you for the amount you won it for then you'll take it to court for breaching a legal contract for sale.

Hi Alec, sounds like a complete chimp who's trying to punt this car on for as much as he can get.

You do have a legally binding contract for the purchase of the car, but enforcing it is another thing. i.e. small claims court case, by which time he will have sold the car elsewhere, meaning the best the court can do for you is award you the sum of money the car would have cost you if the transaction had taken place, but the bottom line is of the geeza seems a bit dodgy and has messy mates, it's not worth the bother as all that will happen is he won't pay the judgment and his mates will visit you as your address will be on the court papers.

I have a great idea

Let's get this sh!thead back.

Why don't we all bid for the car by stupid amounts, when the auction ends he'll have to pay a percentage of the final value. One of us will get negative feedback from him but it will be bloody funny and a percentage of 50 grand is probably a fair amount.

That's right - legal rights are all very well on paper, but in the real world amount to sod all, in my experience; those of us who stick to the law/reasonable behaviour get shafted time & time again.

As it is I'm not out of pocket, so it could be worse. Since I've actually had personal contact with him, I'm hoping to resolve the matter reasonably.

Will sending the cash by PayPal and asking when you can collect the car work?

You could say you noticed he put it up for auction again so obviously the sale with the other guy fell through, but you're still interested and so you'll take the car off his hands for the auction price?
