even if its been marked as an uneconomical repair, that wont really effect the cars value or safety so long as its been repaired to a high (bollox to the cost) standard.

Hi Paul,

Beautiful looking car, and certainly worth more than 3K!

I trust your Solicitors have taken proper instructions from you with regard to the car, more often than not even YOUR solicitors arn't that interested in the property damage aspect to a third party claim, they're just interested in the injury side of things, that's what gives them an entitlement to claim their costs, and since the change in the County Court rules a few years ago, the costs are fixed.... and so the last thing they're interested in is making the most of the value of the accident damage portion of the claim.

In answer to the few posts that have mentioned whether of not the drunk guys' insurers are obliged to pay out, THEY ARE. Although given that he's in breach of the terms and conditions of his insurance, and thereby in breach of the contract that they have with him, they may choose to pursue him personally for the total cost of the claim. Although the chances of that happening I'm afraid are slim, what are the chances of the drunk idiot having the means to satisfy the Jeep drivers property damage claim, personal injury claim, and solicitors costs, in addition to yours? Tragic, but he'll probably get away with it.

My advice would've been not to involve your insurers at all. His insurers can't object, it's for you to decide whether you wish to involve your insurers. The only duty placed upon you, is that you've got to a act reasonably, and to keep your losses to an absolute minimum. I'd have gone to a SPECIALIST accident solicitor and asked them to represent you on a "No-Win No Fee" basis. They would have organised a specialist, independent consulting engineer to assess the pre-accident value of the car. In addition, they could have arranged to obtain evidence in support of your physical injuries, and if necessary, evidence supporting your claim for psychological trauma / PTSD. This evidence would have been obtained from a specialist psychologist at no cost to you. Additionally they could have arranged treatment for you at a private hospital. As a claimant there is NO obligation placed upon you to use the NHS.

As far as the car's concerned, given it's documented condition / mileage / rarity they may have chosen to make you a cash-in lieu of repair offer and the car may have escaped being entered on the MIAFTA register.

Unfortunately, given that you've involved your insurers, and presumably they've paid out, your car is probably the nicest Cecotto on the "list". And worth commensurately less as a consequence.

You might have a claim for diminution in the car's value, given that it's been damaged and repaired. Ask your Solicitors.

Well, insurance now offered me full amount of what it is insured for! 7K, had to pay 1750 to buy her back but i`m happy with that!

She`s all straight again, goin to she her 2mora and i`ll get some pics!!

i was sat there thinking i need a new screensaver for my phone and remember when reedy first got the m3 and how it progressed so quickly with little bits here and there. so came on here and did a search in photo gallery for reddy m3 and the first thing i see was this. glad its all working out for ya again mate. i fucking hate drink driving. of all the cars to hit it had to be yours and not another mass produced tin can from vospers. :)
