just to add my dad was stopped a couple of days after he bought a car and had insurance but no TAX and was going to a pre booked appointment and the coppers asked for the number of the station and phoned them up just to confirm and that was the end of it.

No, but not because you are allowed to drive withought MOT or Tax to an MOT test, you would not be able to because the car is not fit for the road.

And an MOT is not proof the car is fit for the road either!

Remember a MOT certificate confirms that at the time of the test, without dismantling, the vehicle met the minimum acceptable environment and road safety standards required by law. It does not mean that the vehicle is roadworthy for the life of the certificate.

and in the example you pointed out a tester would be quite within their rights to refuse to test your vehicle in the first place, on the basis that you should know that given you can plainly see that it has no seatbelts and there are plumes of smoke it is reasonable to assume if you were stopped and had an MOT booked you would be charged with using an unroadworthy vehicle.

The same as if your car had a valid MOT certificate but when stopped by the police you were found to be driving withought neccessary accessories functioning correctly, such as windscreen wipers or wash wipe system (if a windscreen is fitted). legal tyres, number plate lights ect ect.

Ignorance of the rules is not a reasonable defence. Oh and BTW not having wings or a windscreen are not neccessarily MOT failures. How do you think the ariel aton or caterham 7 type cars pass SVA and MoT?

You would be OK without the windscreen! Wouldn't need the washers or wipers either.

3 points and a fine these days, it was introduced to get people to check their tyres more reguarly so they don't fail to notice.

always been trailered there myself, SVA test days always seem to be the coldest/wettest days of the year in my experience.

Why do people always try to be cocky and get one over the authorities? Even if you are insured you can be damn sure if you do need to claim whilst driving about in your untaxed/unroadworthy car they will do every little thing they can to get out of paying for it.
If you can't afford to run the car you have legally then either get a cheaper car or don't bother with one at all.

it was only an example my car has mot and i do checki its road legal all the time its just that people take notice of what we say on here and i wouldnt want any one to drive to an mot with insurance but an unroadworthy car because they read you could do so on here annd get knicked for somthing that they forgot to check cause 4 tyres would be a ban
and as far as ive read you have to trailer a car to sva tests you used to be able to drive it thereb then they changed the rules but dont quote me on that

did you read the thread, its regarding how to get to an Mot testing station and associated topics when you don't allready have MoT or Tax, not trying to get away with anything on a permanent basis.

I'd love to see my insurance company not pay out, provided I was (and I do) follow the letter of the law they wouldn't really have much of a choice. However I am also aware that if my car is out of Mot and/or no Tax and is driven to an MoT testing station for a pre booked test my insuramce company only cover me 3rd party. When the car has both MoT and Tax it is agreed value fully comp.

I agree though if you can afford to run a car legally then don't bother, and that includes having 4 road worthy tyres.

No worries. I know you are allowed to do it, but like yourself think you must be a complete toss pot too take the pee and you run the risk of more serious penalties.
