is it an mot failure if the front jacking points are removed

Do you mean the strange square things just behind the front wheel arch? if so they aren't really jacking points, they were used in the factory for moving the shell around. On my last MOT I needed them repairing, they just removed it and welded a plate in it's place so I would say in answer to your question, No it's not an MOT failure.

Depends how bad the rust is and which side, in one of my old 325's there was a rust hole on the battery side and got an advisory from the MOT guy but it still passed. I think if it's close to the towing eye then they may fail it for obvious reasons, I could be wrong as I'm only guessing....

I think it's within 30cm of structural / chassis. And 'open sores' as well.
