Hardtop and non working auto top

Would i be able to fit Hardtop if my horseshoe doesn't lock in place? I does fully close as long as i keep my hand on it. Or would i need to fix auto system or convert to manual roof?

Pushing the horseshoe down fully, can probably be sorted by making a very slight adjustment to one of the rod in the lid compartment.
