Yea i agree with you. However, the seller is saying the VIN numbers match, the buyer is saying the VIN plate is tampered with, but what they are BOTH IN AGREEMENT OVER IS THE FACT THAT THE V5 IS NOT AVAILABLE WITH THE CAR !!!!. Sorry guys, but am i being thick and if so, please feel free to correct me, but how can anyone buy a car without a V5 !!!!!!!!!!!

Sounds like you have a reputation? You even threatened to call the police and inform them of my "ringer" you dick! The vin plates haven't been tampered with, they both show the correct vin, you just wanted a tech 1 for peanuts.

Vin was bent as a banana, without the log book verification of it being a Sport, i think many would walk away, with all the rot was a breaker anyway, and that was not what i was after.

no v5 is a great bargaining tool but some folk do get worried about it but considering the amount of E30's being nicked isint surprising.

Not everyone is you though golfman. Dont just assume that because "you" would buy a car without the correct documentation, that everyone else would or should.
This has got nothing to do with being friendly, and everything to do with doing the right thing. If you are as genuine as you say you are the, then give him back his deposit, and then get the belt out and use it until she finds the friggin V5 !!!

Iv lost a week of potential sales due to this man, I also mot'ed it at his request. I am the one who has lost out here. If he was that bothered about the v5 why did he ask me what I'd take for the car knowing I couldn't find it?

Just give him his money back mate, im with you on this but the last thing you want is trouble on your doorstep, this guy don't seem right with some of the stuff iv seen in this and other threads. Find or apply for V5 and put it back up for sale.

Your not really out of pocket, you got a years m.o.t so will attract proper non-dodgy genuine buyers, even push the price up a bit.

Taking a deposit from someone who hasn't seen the car is asking for trouble IMO.

If they want the car that badly they will make the effort to come and see it/get it and either agree a price and leave a deposit then, or come and pay you in full and drive it away.

When selling a car privately I always tell buyers that if they want to do a deal, they view the car, agree a price and drive it away - that way you don't get any of this crap.

if you take a deposit from someone who hasnt viewed the car, what happens if the following day someone rings you who could come and see it and pay you full cash asking price the same day and drive it away ? You tell him "sorry pal but I've just taken £100 off someone I've never met, whose never seen the car in the flesh but says he'll buy it next Tuesday ?"

Madness - when buying cars whoever turns up first with all the money gets the car. If you have to take a deposit from someone because they can't collect the same day then ONLY take their money once they've viewed, test driven and approved the car and you've agreed a price and timescale for collection. Simples.

Surely a £3 Mytextcheck or even a full blown £20 HPi check together with a quick call to your local dealer with the VIN before you spend any money travelling to see the car or stumping up £100 deposit would tell you exactly what it is.

Sounds to me like you prefer to try and intimidate this seller into thinking his car was dodgy to get it for a lower price with nothing of any substance to actually back it up.

***Edit - just noticed this newly MOT'd "apparently genuine" Tech 1 Sport was up for the eye watering price of £800 - whether it was or wasn't a genuine sport if all the bits were present WTF did you expect for £800 ??? :roll: ***

Maybe you folks have never been in the situation whereby you have travelled miles to pick up a car and upon arriving the car does not have its paperwork. I have and i can assure you, i will never do it again. No paperwork, no sale. It really is that simple !!!!!!!!!!!!!

Absolutely not - although there are some instances of course where there could be a genuine reason why the V5 isnt present.

As for travelling miles - when you make the call to arrange to view the car is it so hard to tell the seller that if the V5 isn't present you won't be coming to see it ?

Can't speak for anyone else but i;m more interested in finding out
which party, seller or buyer, is lying about the Vin plates and why.

Would i buy a car without a V5?, well yes, IF everything on the car checked out ok I may well do. That would include a HPI check.

That is nonsense. Sorry, but it is the sellers responsibility to ensure "THEIR" paperwork is in order and present before the buyer sets off. The paperwork for the car is basics and if the seller cant ensure the buyer can view the documentation for the car on arrival, then god only help the rest of the transaction.

Come on guys, this is basic stuff. I can forgive the Service History, The manuals.....to some extent the MOT....but the frigging V5 !!!!!!!!!!!!!

Both at fault here; if no V5 is producable, the car cannot be driven. Of course, it can be sold, but remember that a police officer can issue a producer that ALL required documents be submtted to a police station in seven days, and the V5C is one of them, so a car should (note, SHOULD) only be sold if it's being carried away on a trailer.

Considering the V5 is therefore a required document of the vehicle, just like tax, MOT and insurance, it's the seller's duty to inform any buyer that the document is not available, NOT the buyer's duty to ask. Based on that, the buyer deserves his deposit back, and there's not really any counter-argument. "I didn't know I lost it" is still your fault (or your girlfriend's).

As for the buyer; IF he lies and says the VIN plates don't match, and uses this to negotiate a deal, he is entering into a knowingly fraudulent business deal. IF he's telling the truth, and the VIN plates have been tampered with, and he STILL makes an offer, he is admitting that he recognises the illegal history of the car but is still willing to enter into an illegal business deal (that of knowlingly Handling Stolen Goods). From either perspective, neither a criminal court or a civil court will accept his claim of any wrong-doing on the other person's part.

Considering I'm 1000 miles away, I have no interest in either of these two gents OR the car. I'm therefore willing to look at photos of the two plates and verify whether they match or show any signs of tampering, so that the seller can get the car back up for sale with a clean reputation. But both parties involved need a good rap on the knuckles.

Yes this is true - but If I were travelling any further than 30 minutes away I would ask the seller on the phone when making the arrangements to view what paperwork he has for the car, making particular reference to the V5, current & previous MOT's, Service history and handbooks - anything else such as receipts is a bonus.

I certainly wouldnt be putting diesel in the car, buying train tickets and/or booking time off work to travel from one end of the country to another without getting verbal confirmation of what paperwork is available first !

If you assume ANYTHING when buying a secondhand car you're asking for trouble.

8O I wouldnt be returning the deposit if it was me, I would be welcoming him to come and collect it if I was in your situation.

But saying that, I have dealt with Ata and he has always been a pleasue to deal with to be honest.


I'm not standing up for either side on this unless we see what Ata was saying about the vin plate... But I do think you should be taking a picture of it to either highlight Ata was trying to scam you or whether he was telling the truth and its his reputation on the line here. Even if he doesnt handle situations like this well and turns into a 12 year old with his replies. :mad: That doesnt make him a dodgy trader just yet.

By all means, dont provide pictures, why would you to prove to a bunch of randoms on the internet? But if he was lying, you'll want to show the rest of us. If you cant show us in pictures, then i'll assume Ata wasnt in the wrong...

I agree. Lets see a picture of the Vin plate and if it is straight as a nail and does not look tampered with then then it looks like you have the support of the forum, however if it looks like it has been removed and if it is as bent as Graham Norton, then boy you are going to get both barrells from this forum i assure you.

Better still, why dont you tell someone where you are. I bet someone from the zone is local and wouldnt mind a Tech 1, i for one would be interested.

The ball is in the court of the seller as far as i am concerned.
