I bought an old e36 touring from a dealer a couple of months back
I travelled a fair way to get it when i picked it up he just got me tosign logbook and gave me a receipt and off i went
I didn't recieve logbook after about 4 weeks so i applied for my own it turns up today and it says on the notes this vehicle was subject to a major repair and or accident damage

Now how do i stand with the dealer he didn't mention anything about car being a write off nothing mentioned on receipt
He was also meant to forward service book etc and never has
ok the car was only cheap but i now want to get rid as i have bought another car what should i do.

as long as the car was repaired then you should be fine, he either hasn't sent the V5 off or its gotten lost, V62 for a replacement V5 i'm afriad, means a trip to the post office.

Dealers or private sales do not need to disclose the vehicles history or tell you any accident damage, the occasional honnest one will as accident repaired vehciles automatically loose about 30% of their value, probably why it seemed a good deal at the time. HPI check etc would have shown this up.

I didnt bother with an hpi down to the fact it was only £495 I'm not going to pursue the matter with the dealer 3but i thought they had to disclose any vehicle that is on the vcar register
to be honest I will probably break the car

probably get more than £495 for frag and get the local scrappy to pickup the rest, my way you get minimum £200, add on the frag parts and its a nice little earner.

The last HPI check I did on t'internet cost me 3 quid. A worthwhile investment.

Sorry to here this but you need to be less trusting....


I have seen some ok ish 500 quid e30's and e36's. Luck of the draw I guess.... Trouble with a dealer is its either getting rid of scrap trade ins or he is going again (i.e. he paid 2-250 and is doubling his money).


Better off going to look at local 6-800 quid private sales and haggling hard!

I never buy off dealers as a rule because i don't trust them :shoot1: i do know a bit about buying and selling cars and hpi checks etc but on a£495 car I'm not going to lose too much sleep.
my original question was more about whether a person or for that matter a dealer has to disclose whether a vehicle has been subject to damage ie cat c or d .

I used to buy and repair stolen recoverd vehicles many moons ago and you had to tell people then so has the rule changed and i know now that some information is printed on the logbook but i didn't have a logbook to see this info.

I would just put this down to experience mate.

Why don't you just stick it on ebay and try to return some of the cash, no reserve £200 start and get rid and be done with it. That's what I would do.

OR

I would just carry on driving it if it had T&T

Don't know if theres anything in law that states its the dealers responsibility to disclose whether a vehicle has been subject to a write off in the past - in fact I would expect not - as with everything its a case of buyer beware !

Most larger dealers will HPi everything that they intend to sell to ensure they don't have any comebacks - that way there is no need to disclose anything.

Smaller "portakabin" dealers or traders from home may not be as diligent.

Depends on the ad wording and what the dealer tells you IMO - if blatant lies are told - i.e the dealer tells you its HPi clear and/or it says so on the ad which then turns out to be false then you should have some comeback if you want to return the car for a refund. If the dealer says nothing I'd say its up to you to check - to be honest I'd expect most dealers to say nothing or gloss over it if they are selling a car they know to be dodgy. :roll:
