the first offer is always a rediculous long shot by the insurance company. when i crashed my last project as it was so highly modified they didnt know what sort of price it was worth so offered me book price for a 1985 toyota celica which was a silly £200. it took a while of haggling as they deliberately try to grind you down hoping you will give in but eventually i got a few thousand quid and the car back to strip,which at least got me my cossie engine back.prepare for a long battle but dont give up. if you dont accept their second offer im sure you have to state your case for your valuation providing proof of values etc.if it still isnt agreed on im sure it then gets passed to an independent assessor.what happened to the drunk?

Before you replyed with the above I was going to say I bet the bloke got fined about £200 and banned for 12 months. This whole thing is a total joke. You are having to claim off your own insurance I guess? Is there not some fund that is set up that pays for tossers who drink drive or have no insurance?

Havn't read all this thread ,but sounds as thou the insurance co's are up to their usual tricks !
They have got us over a barrel.............law says you have to have insurance.......they charge us threw the nose and come pay out time,they come out with proper insults..............bunch of fecking bast@rds :evil:

Reedy , do not let this drop ...............take the f*ckers all the way (even when they make it look bleak,and they will ,keep at it).................and don't cash that cheque for 3k if/when they send it!

it got me 2700 for my tech 1 over 7 years ago when their value was pretty low, thier innitial offer back then was £1000

Kos, i think a lot depends on how they feel on any given day!

My claim was a 6-7 month battle and ended with a phone call out of the blue from some bigwig who ended up bartering there and then!...........i got my money i had been after plus they waivered the excess (which in itself was over £600)............I'm certain that this was down to my persistance.............it's great when you know your right ! :D

In answer to post on another page there is a government fund to pay out for c*nts with no insurance as my mate had to make a claim against it, but i can't believe insurance companies just expect people to roll over and go "oh ok £1000 for a car worth nearly 6k? well that sounds reasonable"

I'd have to pay him a visit, give a 16 month walkin ban. Fire off a few letters and or e-mails to trading standards, ABI (Association of British Insurers) and anyone else who will listen even contact BMW magazines, and let your insurance company know who you are letting know about your claim and how much of a fuss you are kicking up, at the end of the day if they think your gonna try and get this injustice we all suffer in the magazines and news papers, they will think about just trying to shut you up, because if someone with power takes notice... you could be the jamie oliver of the insurance world lol, and thats the last thing they want.

Reedy, get in contact with the BMW Car Club to give a written evaluation as to the true value of the car. Especially as it was special edition, so long as it was insured as such.

Even regular m3's in that condition are at least double that offer!!!

will the drunk drivers insurance cover it though as technically they could declare his policy null and void as he shouldnt have been on the road at all whilst under the influence so its not their duty to pay out leaving you to chase the driver for costs through a private prosecution.your insurer will have to pay out to you then persue the other driver which will count as a claim on your record with the loss of your no claims until the case is resolved which in my experience can take months/years :cry: it always ends up with the little guy whos the easier target(ie, you) getting a shafting from the insurance company as they will do all they can to wriggle out.i found the insurance ombudsman very useful when i had a no fault claim drag on for about 15 months or so with no progress. after a call to the ombudsman the insurance co suddenly took to phoning me to assign a specific person to me to sort my case as a matter of urgency.6 days later it was resolved winkeye

i presume the car's going on to a jig, looking at the origianl pics, the NS chassis legs taken a hit judging by the angle of the bumber iron.

Kos, Yeh chassis leg was bent downwards! will be jigged, then strenthend (sp) up for the new lump!

Also bigger discs and coil overs goin on!!

haven`t been paid out yet, but she`s off to the bodyshop soon and i aint waitin around for my insurance company to pay me out before i can start fixin her!!!

Don't know if this has been said but get every photo that shows off your car looking spotless, get BM club secretaries to value it or trophies from shows and also find the nearest car/s for sale that are similar and get your insurance company assessor to come and look at your car show him the detail that you've got and tell him that there aren't many left limited production run and all. And that you will not accept the car being written off, insist on a new shell. I had to do a similar thing for my old car, the body shop said that the dashboards weren't made any more and they would have trouble finding one I went straight to the dealer asked to do a parts search, low and behold 12 left in the country. Strips torn from the body shop manager backside and one FOC full respray later courtesy of VAG, me a happy bunny.

the top part of the leg can be replaced where it joins the main rail. but before you you start with the repairs mate be carfull, as much as it hurts you it may not be worth fixing it. if they do pay out a s "cash " setlement, they will still mark the car as being beyond economical repair, which in real terms is a right off, also they may say they think its un safe to repair etc , just hold oput a buit longer, you've waited this long, a little longer wont hurt. aslo if you do keep and then fix it when if ever it ever comes to re sale you may struggle with the history.

also to fix that right, its going to cost a fair ammount, i've re built my M3, replacing pretty much what you have to replace and it always cost more than you expect it to.

the top part of the leg can be replaced where it joins the main rail.

maybe it migh be wise to let it go, break up and sell what you can and buy an other ?? no one like to let there pride and joy go, but some times its just the right thing to do.
