Not through choice!

This is what has happened/happening, i hit someone up the arse before crimbo in the sport at 2mph at a roundabout. On the way to exchange contracts to for my house i just bought. It was basically one of those they are going oh no they are not. I scratched his bumper down to the primer, i made a mark about 8inches wide and 2 inches deep. No dents etc, and i put a small mark on my brand new number plate.

Foolishly i only gave him my phone number and reg, but didn't take his phone number. I know, i know. Fault number 2, i assumed he would phone me to let me know what he was doing. He's going through the insurance, i obviously don't want to. I have no way of getting his details (all i know is his name and he is with direct line) and my insurance renewal came through with a quote on 0 NCB's at Ԛ£2850 TPFT, i guess this is because i have a pending claim.

Insuring the car else where might be a no go because it's modified a fair bit. So with no NCB's and a 4 year old SP30 would prove difficult to find someone else on a half decent price.

I have a mortgage now and that kind of money is not there, and i wouldn't pay that anyway. I'm trying to get my insurance company to sort it out and i'll pay afterwards and keep my NCB's. The insurance company are not sure if i can do this. :cry: Even if this solution did work out, i expect it would still be on record and they would use it against me in future.

So i am in a pickle and if this does not work out i may have to sell the old girl as i can't afford to let it sit in the garage, if i need the money to insure and buy something cheaper! It's the only object i own of any value bar the house!

And if i sell the sport then i might aswell sell everything i have E30 because most of it was bought for use on this car. And if i can't have the sport i can't use the rest.

Simon, this is a terrible story. I would suggest to contact your insurance company to put your story aver to him on your behalf. Get them to tell him your circumstances with the house and the car being your pride and joy and that you will pay for the damage outside the insurance company and keep your fingers crossed.

Nope i don't have his reg. it was a newish audi A4, new enough to be a company car, which is maybe why he is going the insurance route

liek ant says there must be someway of geting a hold of him

phone your insurers mate and ask for his details, I can't see why that would contravene any data protection and i can't see your insurers having a problem if you are volunteering to pay the claim instead of them. Only trouble is, you may go weak at the knees when you see the cost of his repairs.
It may be too late as your insurers may have authorised the repairs and they could be under way, at which point the only hope you would have would be to offer to reimburse your insurers in the hope of allowing your NCD, but get them to confirm they will in writing before you stump up any cash.

Your premiums would increase in any event because of your duty to disclose you have had a bump and it will be on record even if they don't rip your heart out and pisch on your NCD.

If the bloke is claiming injury, and some people will have a go even at those speeds, then you will have no chance than to leave your insurers to it.

apologies, it took me so long to type that post I was a bit behind the times

thinking of something that could help, can't understand your insurers attitude with his details.

Section 154 of the RTA requires parties to exchange details in the event of a RTA, due to your circumstances at the time and relative youth, you were unable to do this and are now making a reasonable request for the third party details from your insurers.

If you can get a reg number then I could get you his details, but it could take upto a week and it may be too late by then

would it not help to say to the insurers that the bloke would not give you his details
as opposed to not asking for them.

surely if somebody did this it would almost be the same as
leaving the scene of an accident.

or am I talking silly

Absolute shite - this is my big grievance about insurance companys, and more so "insurance approved" repair companys.

When my 200sx rear bumper got hit i took it for a quote - Ԛ£880 feckin notes, including replacement bumper (it was only paint damage) and even worse they listed bumper brackets being replaced - the car does not even have them!! its uses seam welded mountings that were not even damaged :evil:

In the end i had the bumper repaired/sprayed and brought a new fixing kit direct from Nissan - got it done for less than Ԛ£150 in the end

It was the boss who hit my car btw :wink:

Is there no way you can request via your insurance company a copy of the quote for the work, then contest it - surely its in your insurance companys interest not to get ripped off?

As everybody else im sorry to hear this. What tylerma has said could well be worth a try. What a picky asshole the other driver is.

Thanks so much for the advice, it's hard to think of all the avenues to go down when your on your own as such. :thumb:

I will try all these new suggestions 2moro and what i have already been doing.

I haven't devoted the time it deserves sorting these things out, with it being Christmas, moving in etc and and thinking i'll do it the next day. Let's hope it doesn't cost me dear.

Ring profile insurance - ask for Lee ,they were doing my sport for Ԛ£350 comp!!
and got my M5 for Ԛ£450 through AQUOTE - AD IN BMW CAR- PM me for the number

damn thats gutting man but dont give up your ride just yet, get some insurance quotes from other sources before you take the plunge, there has to be a way out I couldnt bare the thought of selling my car in that situation, best thing is to contact the geezar via the insurance just gets messy when insurance companies are involved. Hope it gets sorted.

Give Lancaster insurance a call www.lancaster-ins.co.uk their regular policy quoted me Ԛ£618 TPFT on my track 325 and i'm 22 with no NCB and a 3 year old SP30. Just don't mention the T word to them(trackday). I think their fully comp price was 940 or thereabouts.

I was in a crash and the police told me you have to exchange names and address's by law. So push the fact that you have a lawful write to have this information otherwise it could be as someone has allready said leaving the scene and failing to provide details. As for the repair costs you can pay out of your own pocket and it would'nt affect your NCB, or youn could try and negotiate to have the repair carried out by someone of your choosing and too the other partys satisfaction. If they do decide to go through the insurance approved repair'er I dont think you can do anything, someone try'd this with me and as it wasnt my fault I let the approved bodyshop do it. Good luck though

Well i 've spoke to them today, and they won't give/find me his details as they think its gone too far now anyway because it happened on Dec 7th, and his car is probably fixed now. I was also told i have no right on how he gets his car repaired, meaning privately or through the insurance.

Interesting i will phone them back and demand his details if the law states i am entitled to them. If i get them, i will phone him and explain peacefully my situation just to see what he says and ask him why he didn't have the decency to phone me and tell me of his intentions.

I can pay off the costs and get my ncbs back. But on the 14th of Feb my insurance is up. So i need to find a quote on the sport or auto 325 with no NCB's. And hope i can get my ncb's back and a refund off whoever is insuring me. What a sticky mess as per

Still not looking good though.

My brother in law has first refusal on the sport. If i sell it to him for 2k then i won't lose track of it, in case i want it back in the future. He only lives next door but one to me!

I will ring again 2moro then.

I thought if you had a minor(ish) bump you only lost 2 years NCB ?

How many NCB have they said you would lose ?

Could you get your mrs/mum/dad/etc to insure it and have you as a named driver ?

Well, i'm going to see* what it will cost on the 325SE i have which is standard and auto. being a 2.5 also will not help, but it was a cheap and cheerful motor.

Otherwise i might get my girlfriend to drive my sport and i will insure her golf. Or i might swap my sport with me bro in law for his polo, or sell it to him cheap with a view to buy it back in year or so. These are my ideas so far.

You can't do this mate, you can't get rid of it.

There are a few options which mean you don't loose the car, I appreciate that I'm kind of doing the same but the situations are different.

You will hate yourself if you sell the car (I know I'll be gutted), try to find a way around it, don't let these wan*ers beat you!

Don't do it Si, i'm sure you can find away to keep it. Even if it means not being able to drive it for a while at least yo'll be able to get it looking spanking and do everthing you've got planned for it!

Hmm but as far as i know a standard sport is only 1 insurance group higher than an se auto so i can't see you saving a huge amount. Unless your sport is "highly" modified (which i can't remember it being??) its not going to save you a huge amount to switch over to that auto. Get begging with the insurance company to give you the details of the other owner, make some shite up that he left his gold pen in your car or something, keep trying and pestering as you'll speak to someone different each time so it can't hurt to keep trying.

Good luck, just remember insurance is legalised robbery and that no one benefits from it bar MR norwich Union and the other mugs, may as well go round in un insured cars these days and risk it like all the scum do around my way :?

Simon - i had thought initially that he was dealing directly with your insurers and they would have authorised repairs, but going from a previous post of yours it sounds like your insurers do not know what stage repairs have got to, suggesting that the bloke is using his own insurers to get his car fixed and they will then tap your insurers up for their outlay.

So when speaking to your insurers, ask them to confirm have they authorised repairs or had any contact from the third party himself, or have they been contacted by the other bloke's insurers?

If you state your intention is to settle the third party repair costs directly and thus allow your NCD to be reinstated then I cannot understand their attitude at all and they are just being obstructive, particularly when your intentions would save your own insurers from having their trousers taken down for his repair costs.

Also ask them what on earth happens if they have not been approached by him or his insurers for any money by the time you come up for renewal? Are they just going to stiff you by not allowing your bonus or are they going to get off their arses and enquire what the other bloke is upto? What happens if in 6 months they have not been asked to pay his repairs? still shag you over for a racked up premium by not allowing your bonus? This is a situation that can be avoided by them giving you third party insurance details, as you are entitled to under section 154 of the Road traffic Act.
