So this happened about an hour ago...

a moped went into me. No one hurt...

I have never had an accident before...especially not in my e30 so what do I say and do to maximise the situation in my favour????

Obvious damage to back end, startec light...not clear in pictures is dent in boot lid and mtech kit at exhaust is buckled...

Oh crap!

Well you will most likely have a fight on your hands with the insurance company to get it repaired and not write the car off!

Has the moped rider admitted liability? Got witnesses and good photos?

Parts prices / availability have the potential to make this a BIG claim ! Bearing this in mind, the insurance company may want to do a 'cash in lieu' settlement. Just make sure the quotes look frightening enough. A couple of main dealer ones should do the trick ! :) The Startec light will be a problem as they are long NLA and unless you get lucky and find an odd one, people are now asking £400+ for minters ! :eek:

Lee, beemerlad is the man to speak to as this is his line of work. he was last seen getting excited over a Seat Leon in pub talk ! 8O

Don't believe him! I had the same situation and when he got home he decided to try and blame me, took months to sort out, I had to go back to the scene and take a load of pictures, print off google earth pics etc etc, if id have asked for a witness at the scene it would have stopped the faff about

Third party means it is his insuranse that will pay for your damage. I would not make a big deal of the aftermarket lights and be happy with used oem tbh :) Witnesses saved my butt when a pedestrian jumped in front of my van, just to say how important a witness report is, as well as a police report.

What is your car value in your insurance policy?

Not sure of the value on my insurance...but it has been resprayed, new interior, new roof...so it is worth more than when I first insured it...

Non fault and you can demand it be fixed

Speak to Lee at free motor legal ASAP.

Tell your insurer what's happened and tell them it is "for information reasons only" what's happened and that the 3rd party will be dealing with it for now

There was an off duty police officer that stopped and helped...phoned it through and got us a case number etc...

So can his insurance write it off?

My insurance has said they will contact his insurance only to inform them that they are aware and will be letting them deal with it. They have confirmed that it will not affect my no claims bonus or premiums...

I was told that after a car is 25 they are only insured 3rd party???????

And it may cheap where you live but not where I live...+-£900 a year for 3rd party....

No...I did not realise that the lights needed declaring...but they are now as my insurance is due for renewal on Wednesday so they did for me...

Are you talking about the Mtech kit? What if it was on the car when I bought it?

That needed to be on a classic policy with an agreed value on Fully comp terms in all truth.

But seeing that the other guys insurance will be dealing, search every classic dealer for similar cars and DO NOT let them decide the "market value". Make sure it's you that supplies them with the evidence of a true current value. Unfortunately, you will have a fight on your hands.

Get Lees advice ASAP.

Good luck trying to get a car insured on a classic policy when its parked on the road in Kensington.

Hope you get the claim sorted, just need to sort out the front wing as well.
Then people need to think again, Having something like this 3rd party insured is madness in my mind.

I hope it gets sorted.

I've not had 3rd party fire and theft since I was 17 lol, whenever I clicked lately to try differance its been more than fully comp lol

I thought cars under a certain value are do not qualify for 3rd party insurance only.

Thanks to everyone for the advice...especially Lee who put my mind at ease...

So the update is that having spoken to the other party's insurance company it is confirmed that he has admitted full liability so they accept that they will need to sort this out...result...

I have an estimate for the repairs...excluding the startecs...of £1972.27 so hopefully there will not be any issues...

Watch this space...

The issue will be when (I don't know your car) they value your car at 2500 or less lol Even if they value it at 4k its still gonna be right of at a guess!

That's not what I'm saying fella, if they value it too low they will write it off! From my experience if the damage is say a 1/3 to 1/2 they write em off, easier that way than fix and find more issues!

I understand what you are saying...I value the car at about £5000 before the accident...if they value it at less and decide they want to write it I will fight them on it...either way they will need to pay me and I will get it fixed...

The way I see it is if they write it off they will end up paying more than the £2000 to fix it as I will get solicitors involved and may even need a hire car until I find a replacement...

If I see that they are getting funny I will also suggest a cash settlement...that way there is no risk for them...

Lets see what happens...

Not always the case. My wifes GTI was hit up the back hard! I was with Zurich at the time. At that time, they repaired anything with a repair cost of up to 90% of the value of the car! I was gutted as I wanted it written off and never to see the very bent shell ever again!

I was lucky that the company made such a crap job of the repair, that on collection of the car (3 months they had it) I rejected it, immediately got the assessor down and an inspection from VW. VW stated they would never have repaired it and reported numerous issues with the repair! So in the end, the insurance still had to pay me out in full and accept the car was useless! A very painful and time consuming experience.
