It will work with the doors open even with no key in the ignition IIRC - same as the windows

IT IS NOT A 'KILL' SWITCH, or a 'switch' of any kind. This part is a resettable slow acting 'fuse', and should only be pressed when it has tripped. It also works on the windows only - nothing to do with the roof.
Are the window switches lit as well as the roof switch after the car is parked?

If the sunroof switch stays lit and the windows switch doesn't (with the thermal cut out in the 'on' position), then it looks like someone has been playing with the wiring. The sunroof uses exactly the same supply as the windows.
Any evidence that the sunroof is a manual to electric conversion? There are websites where you can get the original spec. of your car from the VIN, or BMW can supply the info. on request.

I got an electric sunroof from factory, when i have the thermal cut out switch 'off' the window switches are lit and have power, is that normal? and when i put it in the 'on' position they are not lit and dont have power

The window switches are lit as well, with the ignition off and the doors closed, and the roof and windows still work?
If so, pull out fuse #28 and confirm that this kills the lights and motors.
Don't touch or investigate anything else at this point.

Press the cut out in, and NEVER touch it again! It's not a switch.

Open one front door and push in the pin switch in the A pillar. If this makes the lights go out, check that the plastic button in the door frame that operates the switch hasn't gone AWOL.
