e30 totalled whilst parked
Moderator: martauto
Sad to say it, but last night a gang crashed their 420 M Sport at high speed into my 325 convertible whilst it was parked on the road infront of my flat (with me at home). The cars a write off.
The 420 ended up jumping across the road and crashing front first into another block of flats opposite.
Everyone ran from the car, turns out it was rented, and insured, and the police have the idiots details.
Questions:
I have a £4.5k agreed value policy on the car from about a year ago. Since then ive spent months working on the car, and prices have of course risen. As the accident was solely caused by the dangerous driving of the damn drug dealer can I argue with the insurance company that the car is worth more than the £4.5k they are offering?
Part of the policy means that I can also keep the scrapped car. BBS alloys, nice interior etc, but is there anything else that anyone recommends I take from the car? Dont have too much storage space but keen to recoup some cash.
Any other pointers with regards to the insurance claim appreciated.
Thanks

Don't even talk to your insurance company. It's all about THEIR insurance company and you can take them to the cleaners.
That means:
Ӣ Courtesy car for the whole period until they settle.
Ӣ New value based on what you think it's worth.
Ӣ Other potential damages.
When fault is this clear - it's go time!
Sorry by the way - sucks.

There's an insurance specialist dude on here who's a zoner / good egg. I'm sure he'll chip in.
You need legal representation either way. Free motor legal is the chap on here. Their insurer will probably phone you trying to keep you sweet and settle it wth you but i would advise having representation. You won't have to pay though obviously.
It would be worth keeping any straight panels. Pretty much anything that isn't damaged will be saleable. Really sorry to hear about the crash hope it settles okay

cheers Kryptonite. Saw the insurance sticky so will bring that back up, message the dude.
Yeah sucks, the only car he managed to hit, even crashing perfectly in-between two parked cars.
Spoken to the insurance company just to notify them of the details etc. They immediately offered me cash without ever speaking to the other insurance company, which I found a bit odd, so I told them ill call back.
Lets see how things go.

When it's clearly their fault they will try to settle quick. You can get legal representation if you aren't comfortable dealing with them but if you want to settle quick ask for an amount plus a car until you're sorted.
Don't accept anything you're not comfortable with.

if you have an agreed value, that is it. it's your responsibility to notify your insurer of the value of the car at the time your renew it or alter it to notify any changes.
obviously you can fight your corner and say it's worth more but your agreed value will there to beat you with.

That is true in dealing with his own insurance company, but that is an agreement between those two parties, it should not affect what he can claim from the person who caused the damage or in fact their insurance company.ianev wrote:if you have an agreed value, that is it. it's your responsibility to notify your insurer of the value of the car at the time your renew it or alter it to notify any changes.

ive got pictures, but cant work out how to post em,
help appreciated.
Thats the thing, the agreed value should be between myself and my insurer. As all liability lies with the other insurance company I should be free to ultimately pursue market value, which I think is a little higher than the AV I set a year or so ago.
The whole thing is a criminal case right now, with everyone from the car running away, not sure if that would help the other parties insurance company just agree to a cost.

First of all im sorry to read this.
Next, at least the other car is insured.
You can keep all but the shell which with spare parts always needed, is the thing to do, space of course is needed.
Never accept first offer, it's always lowball.
To upload photos you need a photo bucket account or Flickr and copy the [img] link for us nosey nuggets.
£4.5 is already not too bad a price but always worth trying for a bit more. You will need adverts from auto trader to back up your price. eBay not allowed.
Good luck hope you do well.

Phew, they must have been going some to cause all that damage, snap the wishbone lollipop and rip the front strut off!
Your car looks like it could be repaired, but at quite a cost, unless you're able to do most of it yourself...

Sorry to see this...
Do not let either insurance company take your car away. They have no right to no matter what they say, just tell them you wish to sign a declaration to agree the car will not go back on the road that is of course if it is a Cat A or B write off.
Find some means of storing it off of the road, buy back as salvage if you want to break the car and re coup alittle more money back

...not much has happened with regards to the insurance yet. The third party insurance company are still trying to contact the owner of the vehicle that caused the damage.
Keen to start exploring finding a replacement though. Any e30 325 convertibles coming up for sale from anyone?
