Guys just after someones advice.......
come home from work to see my car clamped.
Ive just MOT'd it. After its been sat for 3 years.
It passed ok, so thought I would leave it parked up And apply for the V5.
Done this on wednesday. As its impossible to sorn or tax a car without it.
Anyway car is completely physically off the road (its on the grass verge outside my house). but still DVLC have clamped it for no tax.
They want £100 to release the clamp.
Is the car on the road or off it????
Thanks for your help. What next??

is it on private property? thje grass at the side of the road doesnt count as off the road unless its private property. im surprised its only £100. usually its £120 + the cost of 6 months tax + the cost of the release fee. and you get the £120 refunded when you produce a valid tax disc at the impound office. it cost me just over £300 on one of mine to get unclamped but that was the cost of 6 moths tax included then £120 refunded.

As B7 said it's got to be on your property or it's classed as public highway, there was one guy on here that got his car clamped and maybe even removed IIRC. He thought he was OK as it was in his allocated parking bay outside his house. Not much you can do about it really.

Its all about getting as much money as possible out of the public, nothing to do with illegal cars/safety/environment bollocksTo get your vehicle released you'll need to:
pay a release fee of £100
produce a valid tax disc
If you don’t produce a tax disc you’ll need to pay a surety (deposit) instead. This is £160 for a car or motorcycle and up to £700 for other vehicles.
You’ll get the surety payment back when you tax your vehicle and produce a valid tax disc. If you fail to produce a tax disc within two weeks you’ll lose the surety payment and your vehicle could be clamped again and again.
Release after 24 hours
To release your vehicle, you’ll need to pay a £200 fee, and any storage charges of £21 per day, as well as producing a valid tax disc or surety payment.
Provided you’re registered as the vehicle keeper, DVLA will write to inform you that your vehicle has been impounded and will be disposed of unless all fees are paid.
You could also face prosecution with fines up to £1,000 as well as paying any arrears of vehicle tax owed and costs.
Unclaimed vehicles are crushed after seven days. Vehicles of economic value are disposed of after 14 days. Any vehicles of significant value are resold at auction.

The blokes been caught out though, he cant even tax it as he doesnt have the V5, we all know it can take up to a month or two to get a V5 through! How is he supposed to produce a tax disc within two weeks if thats the situation?

if you were to remove the reg plate and leave it on private property they wouldnt have a number to trace but whats the point ? all the details are on the computer if its in your name and on your propert.just sorn it on line in 2 or 3 minutes and theres no hassle at all.

i agree, it doesnt take long at all to sorn its just ive heard of this before on an old car - some pensioner lost interest and didnt tax or sorn it for years and was sat on their driveway - just wondering if they could do anything about it and what fines would incur if they tried to tax it again

the old "i bought it off a bloke down the pub and i dont know if it was his real name or not" could be used.
its not my car, i just remember my brother telling me they were thinking of buying a car a while back off some old fella down at their unit but it had not been taxed or sorn for years apparently

are you still talking about the orignal post? your clamped car? if your buying it the fact its not been taxed or sorned by the previous owner wont be your problem but you will still need to pay the fees for release as above.
I had my hat nailed on a few years back by the DVLA 
An old E0 touring was sat outside my driveway doing no harm as i live down a quiet close, it had MOT & Ins but the sodding tax expired only a few weeks earlier, I didn't realise as I have several cars on the go.
The van tip toed round and stung me with a shiny clamp and a fine. I paid the fine and got the car taxed, the only reason I did was because I had a cherised plate on the car and it's worth thousands more than the actual car.
It was a lesson learnt and one I dont wont to repeat but I was caught with my pants down. I fully agree catching the pikeys out who do it without a care in the world and the roadside checkpoints are a good thing.

iirc you can pay the fine without taxing the car and put it straight onto private land. i had to do this with an Audi years ago as i had no v5 i explained this and was told to pay the fine then move the car until i could tax it
