This is a stupid post but I have to move a car on Saturday that has just run out of m.o.t. I have insurance and there is rent in the screen. I will be travelling from York to Bradford to sell the car. With the new ANPR if I get pulled what can I expect?

Points and a fine or will they confiscate the car?

This is not something I would usually risk but the car is partially stripped and wont pass an mot.

Advise please.

As above I wouldn't take a chance. You are only allowed to drive to an MOT station if you have a pre-booked MOT. You could risk getting points plus confiscation and crushing of the car.

The only reason that allows you to drive a car without MOT is if it is on it's way to a pre booked MOT or if it is going for work prior to MOT.

You would have to prove your innocence if stopped by the Police which would be very difficult. Therefore, if stopped expect a ticket and 3 points or worse still have it seized.

What Happens if I Drive my Car Without an MOT?
If you do drive a vehicle without a valid MOT it will usually invalidate your insurance, and if you have an accident or are stopped by the police, you will be liable to face prosecution for MOT non-compliance. The only time you may drive a car without a valid MOT is if you are driving to a pre-arranged test appointment or to a garage that will carry out repairs that are required for your vehicle to pass the MOT test.

They only sieze the car if there is no Tax and/or no insurance.
I've had the odd times when driving with no MOT and the rozzers have been ok, but the lapse was for a couple of days.

Find a garage in Bradford and book the car in for an MOT. You are then legal to drive it as long as you can prove it's going for an MOT.

Then when you hand the keys over and have the cash, cancel the MOT!

it's £60 fine, no points, no court (unless you don't pay the fine) although it may also be against the terms of your insurance making you effectively uninsured.

well, this was the case a couple of years back anyway :wink:

No mot does not give penalty points, its a fine. The invalid insurance thing depends, as most state must be in a road worthy condition, so does not technically invalidate insurance. If in the very unlikely event you got stopped, if the mot was only just out and you convinced the copper you didnt realise, its 90% they will tell you to get it sorted asap, as long as all your other stuff was in order. People forget about MOT all the time, i have for over a month and didnt get stopped even doing long journeys.

id rather plead i didnt know it had run out i was sure it was at the start of the next month it was due officer, than say its booked in for mot 50 miles away sir, which they will say so you know its run out and thats not your nearest MOT station, i think we will make an example of you for trying to take the piss.

Thanks for the advise. The car is a nice clean 316 so does not look like a shed. I will however be travelling on the M62. Rozzers always take an instant dislike to me. I have never worked it out :D

This leaves me in quite a dilema.I would happily risk the the fine as long as the car did not get seized.

VOSA problem and they will fine you , that's it. No points either. I've never known police to confiscate a car for no MOT

Also, insurance is a grey area. But inhave known insurance companies to pay out with out a valid MOT

Even road tax, they don't usually seize the car. That is normally for no insurance

if the cops stop you they give you 7 or 14 days to mot it or prove it's been scrapped.

you might get a fine if you find a coontish copper to deal with you winkeye

tyres must be good though .

Why do people blithely hand out advice when they don't know what they're talking about?

Provided it's not a Construction & Use nightmare, no MoT on its own is no big deal, but if there's no MoT and they want to, they'll probably be able to find something else to get you points (tyres is the main one). No MoT of itself doesn't invalidate your insurance so long as the car is roadworthy. No penalty points and no prospect of confiscation for no MoT alone.

However, no MoT does show up on ANPR giving the cops a reason to stop you if they fancy it. Only you know what they're going to find in terms of the car's condition, your documents and your attitude when they stop you and these three will determine what happens next.

Only you can decide if that's worth the risk.

If you decide its worth the risk it may be worth getting someone to follow you there pretty closely so that plod can't pick up the number plate from behind so easily - improves your chances of not getting caught by 50% anyway.

Tyres are nearly new. Cars interior is stripped out apart from the drivers seat and belt :D

The options for anybody that gives you a tug are:-

1) fine up to a grand.

2) a fixed penalty ticket.

3) a producer, which is more than likely, possibly combined with a vehicle defect rectification

notice should they discover something that's not right, i.e cracked lens, bulb out etc .

And then it will end up in an MOT station anyway.

My advice is MOT it prior to taking it on the road and if it's not good enough to pass the mot then it

really shouldn't be out and about.

I don't want to sound sanctimonious on this but if your on the wrong end of an accident and a

pedestrian is involved then your going to be on a sticky wicket!

Personally I wouldn't risk it!

Unplanned collisions happen!

In addition I think you'll find that it has to be booked into the nearest available MOT station to the address at which it's registered. So don't be tempted to follow the well meaning advice about testing in Bradford, any cop that pulls you would see right through it! :D

Seriously good points here, the last one I didn't know. Thanks for the info.

Seems that the 3 options are

Risk it (unadvisable I reckon)
MOT it locally
Trailer it.

Not ideal really by the sounds of it :(

I'm not sure but I think your insurance will not be valid if you do not have tax or an mot, you fail on one of those!!

Booked an MOT more than 160 miles away. Didn't get pulled though.

You could tow it but not on a motorway unless you have a fixed towing bar. Rope is ok for roads other than motorways iirc.

I saw this car last weekend and it's no sorry turd.

I'd do it scott, infact the E36 I bought for the M52 donk had no MOT on it on it's fateful final journey from Notts in limp mode :)

Come on Trevor the police are not stupid, they are however very nasty pieces of work if they want to be and will fck you right over without hesitating, dont trust any of them is the best advice.
Ever heard of mobile vehicle inspection? If they find a defect they WILL recover your car to a compound and slap you with a big fine, recovery and storage bill. Just because they can....

Ive been let off for no MOT in the past, but that was nearly 10 years ago when things were very very different, motoring fines are now big business, we are the only idiots in the world that would allow ourselves to be pushed about so much.

It all depends on how much of a shed your car is and what your attitude towards the copper is.

I have been stopped twice with no MOT, both times in my sport! :o Once when i totally forgot and it expired, i was cool with them and they said just get it sorted asap.

The other time was with no tax or mot. I was on my way home from work and i was meant to have had the car mot'd that day but we had a problem with the mot computer so couldn't test.
Traffic cop stopped me as it flagged up on his anpr. It also flagged up no insurance, probably because i only insured it the day before but i explained the situation and he let me on my way. This was last july.

As some people have said, its only a £60 fine which is not endorsable but if you do get pulled and its a traffic cop and they find something on the car which they deem would make it unroadworthy like tires etc then they can issue whats called a PG9 which is basically a prohibition to use the car on a public road until it has been MOT's and the PG9 and MOT take to a police station for the PG9 to be removed.

If your cars not a shed, just play innocent and say you didn't realise it had run out. Just be cool and don't give them any attitude.

Its basically a 316 auto with a stripped interior. The drivers seat is in as is the drivers seat belt. All the other seats and belts have been removed. Everything is top notch. Is it an mot fail without the seats and belts?
