Is 528i (e39) engine identical to 328i (e36)?

i've been reading up on m50/m52 conversion for my e30 and have noticed that the e34 sump is being used to avoid cross member, then i got to thinking would a later model engine fit ie would e39 fit e34 and if so would e39 fit e30 
i'm assuming that it there identical if not why not use them
