Hit by a van..

I was. Today.

Walking along a pavement on the left hand side of a 3 lane road on a 200 yard section between traffic lights, there was an almighty bang, something smacked my elbow and the back of a wing mirror hit the pavement in front of me.

The driver, who stopped immediately, is adamant that he didn't mount the kerb. I'm in full agreement. We also agree I was on the pavement, i.e. I wasn't walking in the roadway. He was doing 20-25mph at a guess, and the vehicle was a mini van, Renault kangoo type thing. It happened at lunchtime on a dry, bright day with good visibility. With the exception of a stiff shoulder on the opposite side, I'm right as rain. Weirdly, the elbow/arm that took the impact is 100% fine.

The incident occured literally 20 yards from the gate of a PSNI station, so there will be CCTV in theory. I'm not actually that bothered about it, except for one thing..

My question is: can you clip a pedestrian 'by accident'? That is, can you, while doing everything right, misjudge the position of a pedestrian walking close to the kerbside and clip them with your mirror? I'm trying to give the guy the benefit of the doubt here, but from where I'm standing it's pretty much de facto the drivers fault if he manages to hit a pedestrian who's on the pavement?!

If the mirror stuck out enough then I don't see why it would be impossible to misjudge the distance.

With that said, it is still the drivers fault.

I doubt my mildly stiff shoulder would be good for more than the cost of a bottle of radox for a hot bath. A bottle of bourbon would be better..

If you misjudged the position of a pedestrian, you didn't do everything right. Your sentence makes no sense.

A car is not allowed on the pavement. A car is not defined by the contact patch of its tyres; it's defined by any part of its body (which obviously includes wing mirrors) protruding over the kerb.

If you saw an HGV take a corner in such a way that the back end swung out over the pavement and clobbered a pedestrian, would you even ask whether it was driver error or not? Of course it is.

I once clipped the arm of a pedestrian with my wing mirror. She was fat and very council - I look back at the incident fondly.

My uncles mate got knocked out by a lorry mirror as he was walking down the path, it didnt stop either. Definitely driver error, if it was a road here you wouldnt want to be so close to the kerb because of all the pot holes around the drains

I might have been walking close enough to the edge of the kerb that my elbow was over the kerb and in the roadway. Does that mean a theoretical argument exists about whether I was partially responsible?

Ithink the driver probably does has to be responsible ultimately..

Even if you were walking in the road it the driver who is at fault, unless of course you jumped into the path of the car

Pat, what is worth more to you. Common decency or a e28?

Sue the fecker! and you were definitely away from the kerb, walking briskly to hand out bibles to the poor.

If you must know, I was actually en route to my afternoon appointment with Mistress Olga. The bible handout isn't until 7pm so I had to pass the time somehow..

Sorry to sound like your mum but as it was recent, see your GP ricky tick! You say you feel fine now, and I believe you, but for the 1 percent chance all is not well that you can't see? Well if you find out in a week or so all is not well, it's harder to prove that's what caused it!

Your mum :D

You can.
I've hit a guy in the face years ago with my nearside mirror.

You cannot even drive through a puddle and soak a pedestrian, so hitting one (even you :D ) walking along minding your own business simply isn't acceptable.

Besides, as James Cracknel (Olympic rower and endurance hard nut) what his thoughts are about this. He got clipped by a wing mirror during his cycle ride in the US. this resulted in a coma and brain damage.

With anyone else that would mean an afternoon of debauchery, Mistress Olga is probably teaching you ancient Greek. :)

It's even funnier when you clout a chav round the back of his napper with a bus mirror. :D (At low speed of course!).

I once ran over the foot of some drunken fool in my E32. He was outside the pub, pint in hand and staggered forward into the road. I felt a slight tremor as my 225/60x15 Nankang put a tread pattern on his poundland trainer.

I hope he humbly apologised for his error and offered to pay for any damage to your automobile :D
