G499 WRT - WRITTEN OFF, DEAD. Insurance advice needed!

Some tit has smashed my car and written her off. Speeding in a 30, couldn't stop and went into my reaqr passenger quarter. Bent the wheel to a 45° angle and stoved in the side.

I need to know what kind of money to accept from the insurance company as i cant seem to find a market value. Bearing in mind it was pretty much mint apart from one rear wheel arch was starting to rust. Went through the MOT with no advisories etc!

How much you think i should accept?

i'm in the same situation with my modified van i'm going to hold out for a decent settlement or insist on it being repaired at the end of the day the car was parked the other driver has admitted liability straight away to the insurance

I would push as much as you can for a repair, it'll be their insurance & their fault - so you shouldn't have to be screwed in any way

let them write it off, buy it back for peanuts off the insurance company, use your payout money to get it repaired or break it your self if you dont want it fixed and you`ll have plenty left to bank and spend as you like.
you should get at least £2000 for a whiplash claim plus your car pay out, most insurance assesors look on the web now to get car valuations so make sure you speak with him and tell him exactly what he`s looking for, if you speak to the garage where its being kept they`ll help you get in touch with him, or arrange to be there when he comes to look at it.
as said above , just because your claiming off some one else does not mean they have to repair it!!
cars get writen off when the repair cost more than half the market value of the vehicle, if it needs a new back wing there`s nearly £1000 with parts, paint etc plus suspension damage thats done??
so not much hope of a repair

Don't deal with your insurance company to start with, there is no need for them to be involved. Adding a 'middle man' just complicates things and you'll end up with less money.

Firstly as long as the insurance companies are not underwitten by the same company you should be able to get a like for like car. As long as the liability is 100% her fault you should get a small premium vehicle which will be a bmw 3 series(e92) or a merc C class. Problems could arise if you are less than 25 though. You SHOULD be able to keep the car until you get the first offer, but you'll have to chase the insurance company for extension

Secondly start gathering similar adverts for similar cars, perhaps get some zoners to make up some adverts winkeye This way they will have something to base there first offer on. The book value will be inaccurate.

Why not? You are entitled to something of the same class of vehicle if its not your fault. Everyone knows non fault business is the best in monetary terms with regards to bodyshops and car rentals. Age of the vehicle doesn't come into it. The only way you might not is if you don't know what you are asking for or if as i said the at fault and non fault parties are underwritten by the same company(eg RBS)

Not strictly so and it's VERY rare you can pull this one off.

Wife get smacked in the rear of her Golf GTI. It's totalled. The best car I could get her was a Focus 1.8LX. Their argument was "it has 5 doors and it's a hatchback and therefore it's similar to your Golf!" At one point they tried to push a 1.0 Corsa on us!

My e34 gets reversed into at work by a cablling lorry. My courtesey car? A Pug 106 with wind up windows!!! When I complained they stated "oh all that like for like was stopped ages ago. It's whatever the repair company can get hold of." I could have pushed a bit on that but the car was only in for 3 days so there was no point.

When my 1989 730i was run into a while back (2007), I was offered a new 730d as a courtesy car. It was a bit big and ostentatious so got a new E90 diesel, had it for 3 weeks unlimited mileage. The 730i was insured on a fully comp classic policy, agreed value 2 grand.

Like for like DOES still exist, take it from me. But it's not really a courtesy car but a hire car that your insurance company will be charging to the insurance company of the twat that hit you.

As for what to do - if you are fully comp you're okay. Your car is unroadworthy so get it collected by a local BMW dealer and taken away for an estimate because you cannot drive it. Get a courtesy car sorted. WAit for a ludicrous repair quote but INSIST on retaining the salvage. Argue and argue and argue until you get the cash you want. Insurance companies charge anywhere between 10 and 20% of the insured value to buy the car back so play it smart and you'll get a cheque for £2500 and your car back. Put the money towards repairing it, job done.
You can normally keep the courtesy car for 7 days after the cheque arrives.

I bought an old xj 40 from the ring a few years back which got hit up the arse by an old geezer.
Car cost 700 quid and was hit lightly but i still managed to get it written off (cat C)
The insurance coughed for a 'delivery miles' brand new Jag S type and i had that for 2 months
I also got 2800 quid for the car and just shy of 2k for whiplash :D And i kept the car.
I then had a lorry decide to move into the middle lane of the M6 whilst i was in it and he side swiped an old e34 turd i had also bought from the ring for 500 quid.
This time the best car they could give me was a brand new Vectra which was a pile of shite and got much abuse for the 6 weeks i had it :D
Not such a good result this time but still £1900 for the car + the car back :P
