crashed in to by uninsured driver

i was nearly killed by a two kids in a vauxhall astra gte being chased by the police outside my parents house today. I was millimeters from being crushed inbetween my 318i and this shitbox of a gte.

picture this me and my girlfriend and our two kids were comming home from visiting her parents in worcester we had decided to visit mine when we got back i pulled up on the kerb as i always do opened my door and got out ready to get the kids out but this time something made me stop. it was the sound of police sirens i looked to where the sound came from to see a white vauxhall astra gte comming up the road at high speed and then the fuckwit driver lost the backend and the car was comming at me. now they say your life flashes before your eyes before you are about to die but for me all i remember is thinking what would happen to my family if i die. the car still comming at speed was zigzagging all over the road in my direction i knew i had to do somthing so i jumped out of its path and it missed me by millimeters. it continued on colliding with my e30 while my girlfriend and my two daughters were still seated in the car. it carried on its destructive path connecting with another innocent driver who later was taken to hospital.
as soon as i saw them run i gave chase and remember hearing my eldest daughter screaming "is daddy dead" luckily for this piece of shit the police caught him first so i ran back to my mangled 318 to find that my youngest was coverd in sick and the eldest crying with her mom. the damage was unbelievable just the drivers side door and the drivers side wing but it is definatly a write off.
after the police had finished arresting the scumbags one came down to me to see if we were all ok.
it turns out that the little chav bastards were driving while disqualified and therefore had no insurance so the little fukker fucked my car and i cant do f.a about it.

if anyone knows what i can do to sort this out then please help me as i have no clue.

the bad thing for me is i had just spent a shitload doing this car up only for some little pric to fcuk it up for me and what will he get a couple of months inside.
and the icing on the cake for me was the police gave me a producer for mot and insurance.

Fuk me... that was lucky! Well, it wasn't... but you know what I mean!

Could you not chase the Chavs through court to pay for the damage to your car...? Or, as it was a Police chase, can you claim from the Police themselves?

It doesn't seem right that you're personally out of pocket resulting from a Police chase...

jeez thank god your ok mate. That must have been really scary. Glad to hear your family didnt get hurt. The kids must have been in shock. I dont have any advice when it comes to claims, (as i am in SA). Just glad everyone is ok.

yeah you can take the chavs through the civil courts and get the money from there...

also the police always have to give producers for anybody involved in any incident, just cos there pricks, but they do it

Fcuk!

Bastard scumbags, fcuking vauxhall's front wheel drive and they can't even drive it properly.

I think you may be right on the write off front mate, as with the door like it is it will have bent the a pillar at the bottom and god know what else, possibly the outrigger at the front is mis shapen too, but get somone to have a proper look at it.

As for claiming get on to a solicitor, you will probrbly find that the cost of claiming will out weight what you may/may not ever get back from them, but definetly get leagle advice on it mate. Even better, are any of your family or mates, or mates of mates solicitors or any way in the legal profession then you can get a decent opinion before you decide wether it's worth shedding out for chasing them in court.

Apart from that mate, your not dealing with an ins company - unless you try claiming on yours, so the car is yours and you can flog every little part of it - if it is a write off.

Bad luck mate, I hope it all turns out ok in the end, and thank god the E30 is a solid car as your Gf and the sprogs are OK.

God, thats awful mate! Glad that you and your family are ok, thats the main thing. Shame your e30 got bashed though. Hope that you can get the chavs or the police to pay. Hate this kind of thing!

You can claim from the uninsured drivers buraeu, theres a certain percentage from your insurance premium that goes into a 'pot' if you like which pays for accidents like these. Look into it further I know it was in action 3 years ago when some norbet crashed into me. Main thing is the family is ok !

im glad everyones alright, the cars still urs, best to break it,

best of luck claiming, i wouldnt bother chasing them up for it,,, they can just declare bankrupt and live off the dole for the rest off their lives and never pay you back. or if they did get a job they would be paying small small amounts a month... or something like that

there are ways to go about it.

glad all ok mate, hate to see zoners in accidents (or non zoners for that matter chav scum excluded)

did you try the Citzens Advice Bureau, that give free legal advice (or at least they used to when i lived in uk many moons ago) definately think you would have a chance as it was a police chase.

As said I wouldn't bother with lawyers they would charge you the price of your car just to wait outside their office.

No zoners in the legal area??? why not try another post being more specific such as:had an accident with un-insured can anybody advise?
that may draw someones attention who knows about that sort of stuff.

As for the car well :?
Check to see if you have an uninsured loss policy with your insurance, that could get you the money for repairs.
I used one years ago and got the money from the courts, it's then up to them to chase the dick thats not insured for the money.

As for the car if the A pillar's not twisted then you may get away with a new wing and door.

Follow the advice from Herrity. I would suggest your first stop is your own insurance company who may be able to pursue this for you (although some may say that comes under an uninsured loss / legal expenses policy).

Glad everyone was OK though.

Lucky you and your family are alive.

I'm with Geeman a bit here, the police shouldn't have been chasing the car if it endangered human life i believe, whether thats bystanders(you) themselves or the twat driving the car.

Seems like the police made the wrong call to me so pursuing them for the money is more likely to get a result I'm sad to say. Perhaps you can take back some speed camera revenue money.

Glad to here you are all ok dude.....

The driver "Should" go to prison for the amount of time he was banned for if he was caught driving while disqualified, and thats going by the guidelines for the courts.

You may be able to claim off the people that did this for the damage to your car, as far as claiming off the motorists insurance buraeu (MIB) goes I think that only covers personal injurys but its worth a try. As for the people that did this getting sent down for the length of time they were banned I wouldnt have thought so, they may get sent down but probably not for long. Its more likely they will get a longer ban and a tagging order with somkind of comunity punishment order, I've seen lots of people that are charged with driving whilst disqualified along with other offences and rarely do they go down, sad but true !
If your really struggleing to get it sorted I could have a word with a few legal bods to try and get a bit of advice on the best way to tackle the case.
As for the producer thats standard practice in cases like this, I had a car written off in a accident that wasnt my fault, I was still breathalised and given a producer. There just making sure your legit, good luck though !!

My mates brother was run over by joy riders about 5 years ago and he's now paralysed for life and in a wheel chair and the fookin scumbags ran off leaving him for dead. When will people learn :roll:

Sorry to here about that Nav and judgeing by the amount of people that come through the courts as persistant re-offender's its fair to say these people aint learning and in my humble opinion should have parts of there anatomy cut off every time they re-offend !

Anyway, my dad is a solicitor, when he gets home il ask him about this. I would imagine you would have some recourse against the police as it was there fault really.

regarding the car, i ran into an un-insured driver once and got told he could still claim through civil action, so im sure you've got a good chance in getting compensated for it

Sorry to hear about the accident, where you stand at the moment, i think is, do your producer at the station, try and make some form of enquiry with the police to get a letter of some sort explaining the accident and then contact the MIB (motor insurance bereau), they have a pool of money that is available for drivers in your circumstances, adn they should pay out. dont email them though try to call them. hope i have helped, and sorry to hear again.

Hmm what police vehicle is that, looks like a "beat" vectra to me...hence it shouldn't be pulling over cars let alone pursuing them. I thought police chases had to be by trained high persuit officers, not some average PC in his veccy.

glad you and your family are not hurt....all is not lost if the owner of the astra has policy of insurance even though he is not in the car his cover will also be for 3rd party risks which may cover your car .......then when the 2 scrotes go to court you can apply through the police for a compensation order to be made at court but these can take ages and the court may not cover the full cost of damages ..the last one is to seek a recourse from the police ....ie if the police were not chasing then the accident would not have occured they have liability insurance to cover this type of event as for the producer this is normal practice to report any accident .....with respect to a claim from the police dont wait for them to contact you they wont. in the event of any claim you have to approach them first once you start a claim they usually ask for the estimates and will authorise the repairs without even going through your insurers. if you intend to mount a claim for compensation then this will hold it all up and they will not just pay out and it will take ages with solicitors and the possibility of a trip to a county court which could be anything up to a couple of years down the line. but before you claim from the police get a estimate for the repairs as you are not dealing with your insurers and the question of writing it off may not even arise if the estimate is a fair one they will authorise it straight away (my car was clipped on the 23 feb by a police car and they have authorised it all to be repaired without any contact with my insurers (i know they always want to be informed)
so no 1 you may be lucky and be covered /dont put to much faith in court
no 2 when dealing with your own insurers they wont spend much and you will definately be looking at a write off(cheapest option for them)
no 3 the best way you stand a good chance of getting your car repaired and back on the road with no lost no claims bonus

Glad you escaped with just car damage, at least thats replacable, although still annoying enough in its own right. I have a friend who had a simular thing happen to him when a drunk driver bounced off of his car so will ask him what he did to get it sorted. Anyway just glad you and the family escaped it.

Shame those theiving scum can't be strapped into a car and have someone drive at them see how they like it. Fucking scum.

not many people know about this but ask a solisitor about the motor insurance buruep
we all pay towards this when we pay our insurance
basicaly if for cases like these and where you need to claim off someone with no insurance
get the details of the driver off the police they have to give you this by law i believe and then pass these on to the mib who after the normal bull shit pay you out and then chase the chav scum at 1 pound a week but you wont be out of pocket

any one who has dealt with the mib (motor insurers bureau) will find they only pay out for uninsured loss where personal injury is involved and not for accidents where those people are not injured unless you can say that the parties concerned are injured ie shock/post traumatic stress disorder but you need to make this known at a early stage as when the police ask if you are ok you are likely to say yes ....this will go in the report book and makes it difficult at a later to say you are injured when you previously stated you were ok also see your gp at an early stage and get it all documented no matter how minor
