If you havn't had the money back then your obviously entitled to it whether its your bank at fault or the seller.
I wouldn't wrie-off a 350 debt and would do everything possible to recover my money.

Not the first time ive heard this about evolve, whose bank is apparently at fault, yours or theirs? Either way you should contact the bank with the transaction details.
The money wont find its own way back to you...

For a few quid you can go through the small claims, If found it works wonders with dodgy ebayers.
Elove would have to prove it was the banks fault and not theres so you should find who is at fault

To be fair core, you are not supplying much info here.
Do you mean their bank, your bank, should,nt be to hard to find out where the fault lies. Have you asked Evolve to supply the transaction details. Have a similar problem with roughly
the same amout of money, and there,s no way i,m letting it go.
Not with Evolve. i hasten to add.

If its their bank its their problem! As far as your concerned they still have your money, get on the phone to evolve and tell them you have emailed them, if they dont want to refund you again tell them to get onto the bank and if you dont hear from them within 7 days you will start pursuing the money through a small claims court.

+1 for small claims court.
Especially if they won't provide transfer details from bank.

Don't let it go, there is some good advice here, follow it up and then go to the small claims. Don't forget things like Citizens Advice for free help. You could also reporting 'em to trading standards (I think).

regardless of where the blame lies id expect the other party to be a bit more helpful in trying to trace the missing money and to try and get to the bottom of it. it must be somewhere but ive had problems in the past with bank payments going missing in the system but theyve always managed to track them down by just knowing the rough day it was paid in and by going through that days transactions by looking for an amount in their records the same as your missing money.
its not hard for them to find it if it does actually exist.

I may be able to help you here as its kind of what I deal with every day at work.
First. How did you pay credit card / or debit card.
Second. When did they advise you the exhaust was not available.
Third. what reason did they give you for not being able to supply the exhaust.
The CAB are crap really being honest and are generally no help in these kind of matters.
Your bank can get the details of the merchant and their acquirer (the people who run their card processing facility) their acquirer should be able to see all the transaction debits, credits, attempts that have ever made through them using your card number. that should also show any failed transaction (i.e. a refund that has not gone through).
Also your bank may be able to claim the money back on your behalf or even be liable for the £350.00 but it is unlikely they will shout about this even if the goon you speak to even knows about this.

Good point, but then again the Danish didn't have any trouble coming over here and getting what they wanted in the 9th century.
Launch the longboats!

I payed by credit card and the money was pulled right after, then after some days they told me the exhaust was out of stock and i could pick another one or get the money refunded right away.
I gave my bank details to the company and after some time they told me they were transfered, but never saw the money.
Sal replied to me on mail yesterday and said i should call him and we would work it out. Gonna call him monday and sort this out hopefully. Keeping you posted.

I never have and never would from past comments and knowing people who have dealt with them , To many people being messed about and taken for a ride to get there item or money back , All you hear on hear is people having trouble with them and lame excuses
Get onto your credit card company and let them chase it and shop elsewhere .

I work for a credit card company and have a lot to do with the transaction disputes department. You should be able to get your money back through your credit card company. But if you tell them you knew almost a year ago that the exhaust was not available they will not help. The regulations set out by Visa and Master Card give you 120 days to report any dispute you have with a merchant. This also goes for refunds not being processed as well. If you need any advice just PM me if I don't know the answer myself I can find out very quickly.

Bought my bilsteisn from them when they did the group buy.
Took over a week to turn up which I accepted because I was getting them cheaper. But it put me off buying from them again.

a week? i wouldnt say thats excessive. i bought my bilsteins from them and had no problems. they were £50 cheaper per axle than anyone else.
but after reading some of the stories on here recently i wouldnt use them again.
